The Criminal Court releases Rexhë Byberi and Abedin Kërrnaja from the cell, assigning them the security measure of "obligation to appear" once a month.

The Criminal Court of Kosovo has released from the security measure of "house arrest" the mayor of Tropoja Municipality, Rexh Byberi, as well as the deputy mayor, Abedin Kërrnaja, accused of abuse of office and illegal logging.

The black squads imposed a mandatory reporting measure on the socialist mayor Byberi and his subordinate Kërrnaja, once a month. According to the lawyers, the 6-month security measure had expired for the mayor and deputy mayor, taking as a reference the Constitutional Court's decision against Mimoza Margjeka.

According to SPAK's investigations, in collaboration with each other, Byberi and Kërnaja violated the law in approving two decisions in the Municipal Council for the construction of roads, causing damage to the state budget of 277 million lek.

This is about the construction of the "Palç Ship Station-Guri i Lules" road, a completely new construction, 80% of which passes through the existing pedestrian street.

In a previous hearing, the court asked the prosecution to question experts who assessed the damage caused during the construction of a road by the Municipality of Tropoja. According to the investigations, the 3.2-kilometer-long road, which for the most part passes over an existing pedestrian path, should have received a construction permit through the electronic “e-permit” system, since the Municipality is the authority that reviews and approves the legal and technical documentation for this type of project.

The prosecution also emphasizes that the Tropoja Municipality was obliged to cooperate with relevant institutions, such as the National Environment Agency for the drafting of the environmental impact report, as well as with the Ministry responsible for assessing the impact and consequences of the construction of the new road.

On July 24 , the GJKKO failed to reach a decision on the transfer to trial of the criminal case against the mayor of Tropoja, Rexh Byberi, and his deputy, Abedin Kërrnaja. Judge Irena Gjoka gave prosecutor Elvin Gokaj until December 3 to question the experts who drafted the act on the assessment of the 2.7 million euro damage.

On March 4, SPAK closed the investigation into the case and forwarded the file for trial.

On September 12, 2024 , the GJKKO approved the request for the security measure "house arrest" against two local socialist officials, while today it decided to release them from house arrest.
