The Head of the High Prosecution Council, Alfred Balla, has reacted in relation to the Public Commissioner's appeal against the decision of the KPK to stop the vetting process without a final decision.
Balla stated that it was a pending procedure and should have been stopped 5 years ago.
He states that the decision of the KPK, although delayed, is correct and that he feels surprised by the complaint made by the Commissioner, comparing it with the analogous cases of M. Xhaferllari, D. Gjunkshi, which according to him leave no room for exercised appeal.
"I will briefly explain to you about the appeal that the Public Commissioner F.Ballhysa made against the decision of the KPK given a few days ago for me. It was a procedure left "pending" in the vetting offices and it should have been stopped 5 years ago when I addressed you with a letter to the KPK. I was separated 6 years ago from the Supreme Court since I was a Legal Advisor and I was relieved of my duties after the term of the judge I worked with ends. So you don't need a legal education to understand that with my legal departure and not resignation from the Supreme Court, the vetting procedure as a councilor had to be terminated without a final decision since it is no longer subject to review and I no longer enjoy the status of a councilor. When I started at KLP as elected by the Assembly, as a representative of civil society, I had been out of work for 15 months. The decision of the KPK, although delayed, is correct. The appeal made by the Commissioner surprised me since his practices of not appealing in similar cases such as M. Xhaferllari, D. Gjunkshi, etc., leave no room for an appeal."- writes Balla.
