The Constitutional Court has accepted the request of the Parliamentary Group of the Democratic Party for priority consideration of the unconstitutionality of the new law on Investigative Commissions.

The court announces that in the meeting of 23.04.2024, it has decided to examine the case with priority, setting the hearing on 27 May 2024, at 10.00.

Regarding the request for the suspension of the law, it has been decided that it will be considered in a plenary session.

We remind you that in March, the vice president of Reestablishment, Gazment Bardhi, asked the Constitutional Court to speed up the examination of the complaint about the "Investigative Commissions" law.

In the request signed by the Chairman of the Group, Gazment Bardhi, it was said that this law carries special public interest, as it is related to the control of the Assembly over the executive.

Among other things, the request stated that the parliamentary investigation is not only a right guaranteed by article 77, point 2, of the Constitution of Albania, of the deputies of the parliamentary minority, but also one of the fundamental functions of the Assembly of Albania, which is related to the exercise of effective governance control.

" In the conditions where the law under consideration affects one of the basic rights that the Constitution of Albania guarantees to the deputies of the parliamentary minority and one of the basic functions of the Assembly, that of effective control of government, it is understandable that this issue carries a special public interest , and its examination should be done with priority, as the Court has done in the previous precedent regarding the request of 45 deputies of the Assembly of Albania for the annulment of decision no. 126/2023 "For some additions and changes in decision no. 166, dated 16.12.2004 "On the approval of the Regulation of the Assembly of Albania", as amended". The priority consideration of this issue should also take into consideration the fact that the request for the establishment of an investigative commission, which is already filed in the Parliament of Albania (see paragraph 39 of the request), as well as other requests in the future may have direct consequences from the application of Law no. 106/2023. Also, the Court should consider the fact that the current parliamentary legislature is in its last year and the extension in time of the review of this request directly damages the parliamentary investigation ", it was stated in the letter addressed to the CJK on March 8, 2024.
