
The "big fish" manage to escape the SPAK and the Special Court's net. This is shown by a report on the results of the work of the new justice bodies, which includes the work of the Special Structure against Corruption and Organized Crime and the Special Court against Corruption and Organized Crime.
The report, which lists and compares the statistics of the work of SPAK and GJKKO, concludes that the high-level officials who were indicted are less than 5% of those investigated for corruption during the past year. The document was drafted by the Center for the Study of Democracy and Governance.
Out of a total of 586 defendants who were sent for trial in corruption cases, the report says, only 32 were senior officials, which is 5.46% of the total.
" This number underlines the ongoing difficulties in bringing powerful officials to justice. There are also significant challenges in sentencing. Out of a total of 479 convictions for corruption, only 20 of them involved senior officials, which is 4.17% of the total. This suggests that although there is an effort to bring individuals in high positions to justice, the number of convictions given to them remains significantly low, thus implying that the challenges in addressing corruption at the highest levels still remain great . , the report says.
Among those convicted from 2020 to 2023 are 3 former judges, 1 former prosecutor, 1 former member of the KPA, 3 former mayors, 1 former mayor, 1 former deputy mayor, 1 former deputy interior minister, 1 former secretary general of the ministry, and 2 former deputies.
Out of 1,000 defendants, the report says, 43 high-ranking officials have been investigated for corruption. Of them, 32 were sent for trial as suspects of corruption and 20 high-ranking officials were convicted of this type of crime.
The small number of high-ranking officials convicted, without considering the quality of the investigation, is an indication that those who were called "big fish" are still untouchable by the new justice. The punishment of high officials accused of corruption and abuse of public funds was the main motive that was thrown to the public justifying the need for a reform in justice. It was assumed that the dismissal of hundreds of former judges and former prosecutors would renew the system by bringing in prosecutors and judges who would curb corruption at the highest levels.
That this did not happen is not only shown by the numbers, but also by a series of investigation files that show that SPAK has a red line that it cannot cross, and in some cases the investigations are pushed back as soon as a political figure appears. The most egregious cases recently are those regarding the investigations of the "5D" company, where all the directors of the Municipality of Tirana and the closest associates of the mayor, Erjon Veliaj, were arrested, while the latter was only questioned by those he called his "colleagues". Other investigations for which the prosecutors have limited themselves to punishing all the high officials involved are those of incinerators, sterilization, SKY ECC wiretapping, etc.
In contrast to what is happening on the side of the government, it must be said that SPAK has not retreated from investigations affecting the opposition, where politicians who have held the highest state positions, such as Sali Berisha, former prime minister and former president, Ilir Meta, former chairman of the assembly and former president, Fatmir Mediu, former minister of defense, etc. / Lapsi.al
