12 mayors and former mayors have ended up in SPAK. For a period of 5 years, the Special Prosecutor's Office has received defendants and conducted investigations for them under accusations of corruption, abuse of office or violation of equality in tenders.
But for former prosecutor Besnik Muçi, investigations are focused on the actions or inactions of local leaders and do not delve into illegal financial activity according to the principle, "Follow the money".
"From the point of view of the investigation methodology and evidence search tools, only the evidence tools are used here, the report, the receipt of documents, the analysis of documents, the numerous sequestration of the mobile device. The law provides, there are interceptions, observations, filming, simulated actions, infiltrations, none of these investigation methods are used. These are methods for the investigation to go deep and wide, to have an all-round investigation", says former prosecutor Besnik Muçi.
Even the criminal lawyer, Altin Kaziaj, says that the Special Structure should expand investigations for officials.
"It is a start, despite the fact that more and more is always required, but the structure of the Special Prosecutor's Office is limited. It is not possible for the structure of SPAK and its subordinates of BKH to investigate a great violence that is happening in Albania, from these people who go to a high public position and only to commit illegalities and to violate the criminal law. SPAK must show itself, to some extent it has partially shown itself" , says lawyer Altin Kaziaj.
Jurists are of the same opinion when they say that the officials throughout the time that they have exercised the duty of the first citizen have believed that they will not end up in the dock.
"A mayor has many things in his hands, from the administration of the municipality, his own citizens, local taxes and duties, plus the making of tenders or public auctions, these mayors are being investigated or people related to them. Not having fear of the law makes these rulers feel all-powerful" , says the lawyer.
"There is a kind of trust of these persons who exercise public functions who commit criminal offenses that will not be prosecuted. They are criminal offenses that are committed in a very visible way, with many traces with many evidences, with many simple connections of facts. This is a fact that shows that the crime has become malignant, the crime of corruption, as it appears in all international reports, the crime of money laundering, which in my opinion has conquered our society" , says former prosecutor Besnik Muçi.
In total during the years 2019-2024, SPAK says that a total of 65 mayors have been referred, where for 34 of them it has been decided not to start investigations, while 18 others are being verified./ Vizionplus
