The debate over the Prime Minister's immunity from the new justice system received a legal response from former prosecutor Eugen Beci.

Asked on Syri TV's 'A Krasta Show' by Adi Krasta whether he would call Edi Rama if he were SPAK prosecutor today, Beci stated that this is a procedural necessity, not a political act. He explained that the Criminal Procedure Code clearly defines the role of the 'person who indicates the circumstances of the investigation'.

" The conditions are ripe for the Special Prosecution to at least summon the Prime Minister of the Republic ," declared Beci. He emphasized that in voluminous and complex files such as those of incinerators or the sterilization concession, where the Prime Minister's direct subordinates (ministers, general secretaries) are under indictment or arrested, it is impossible for the head of the executive to be unaware of the circumstances. His summoning does not automatically imply guilt, but serves to clarify the decision-making chain.

Beci argued that the Prime Minister’s failure to be summoned so far could stem from the fact that prosecutors may have such complete documentary evidence that they consider his testimony unnecessary for the time being. “ If the file has all the evidence that takes you to Rome, you will go to Rome, ” he said, implying that the evidence speaks for itself. However, for the sake of transparency and the full exhaustion of the investigations, questioning him remains a missing step.

The former prosecutor also addressed the aspect of hierarchical responsibility. " If all your subordinates have committed one, two, three, four violations, I as a prosecutor must ask: Are you aware? Did you ask in the morning what is happening?"  Beçi illustrated. This approach aims to break the myth of the leader's 'ignorance' of the deeds of subordinates. According to Beçi, the time when justice stopped at the door of the Prime Minister's Office must end, not for political revenge, but to establish the standard that no one is above the obligation to account to the law for the administration of the state.
