For 8 months, the Rector of the University of Medicine, Arben Gjata, has been under investigation as a "defendant" by SPAK and by decision of the Special Court, he has been put under the criminal measure "Compulsion to appear" by the officers of the National Bureau of Investigation.
Rector Arben Gjata, has committed the criminal offenses of official fraud in cooperation, falsification of public financial cost reports and favoring private entities, in the affair of the concession for the sterilization of surgical equipment, resulting in the theft of 80 million Euros from the state budget.
On September 14, 2023, SPAK and the Special Court sent to the Minister of Education, Ogerta Manastirliu and the Academic Senate of the Medical University, the criminal file and the joint decision for the rector Arben Gjata, as a person under investigation "defendant with obligation to appear".
According to point 10 of article no. 39 of the law "On Higher Education", the Minister of Education, Ogerta Manastirliu, within the date of September 14, 2023, when the criminal decision went to her, was obliged to suspend the Rector of the University of Medicine, Arben Gjata, and send to the President of the Republic , the request for his dismissal.
According to this law, if the President of the Republic would not express himself until October 14, 2023, his dismissal would be considered approved, while the university would be led by the vice-rector.
The Minister of Education, Ogerta Manastirliu, within 6 months, should announce the elections for the new rector, which according to the deadline should be on March 13, 2024.
But Minister Manastirliu, for 7 months, has not implemented the law on the suspension and dismissal of Arben Djata, the rector with a criminal file and measure "Compulsion to appear", while the Academic Senate of the University of Medicine has ignored the SPAK decisions of the Court, as the Senate's chairman is the "defendant" rector Arben Gjata himself.
Even from the senate, for the proceedings by SPAK and tenders and appointments in violation of the law on Conflict of Interest and purity of image; rector Arben Gjata had to be suspended from office according to articles 4 and 11 of the Code of Ethics of the Medical University, which Arben Gjata himself approved, with Decision No. 33, dated April 7, 2022./ Pamphlet
