The Constitutional Court Panel has today reviewed in a public court session the lawsuit of the Coalition for Family and Life, as well as the Albanian Diaspora, which request the repeal of the law "On Gender Equality".

On December 29, they filed a nearly 200-page lawsuit to annul this law, which they say hurts families and children.

"This law is an anti-human, anti-family, anti-God, anti-freedom law, a law that takes us back in time to the law on agitation and propaganda, a law that suspends culture, it is counterculture, it is cultural Marxism, it is not an Albanian law.

"This law must be repealed in the Constitutional Court of the Republic of Albania. And I want to tell you today that this is one of the great battles, it is one of the battles that we do not intend to retreat from. So, we will take our battle to the end to protect the family, children, and freedom," Akil Pano said at the time.

The Law "On Gender Equality" was approved in the Parliament on November 6th amid debates and clashes by the Democratic Party, which has described it as a law that destroys the traditional family and Albanian society.

In principle, according to the majority that proposed and approved it, the law is of the highest standards, guarantees equality between men and women and prohibits discrimination based on gender, in the social, political or economic fields. Therefore, it removes all gender-based differences, exclusions, restrictions and non-recognition of the rights of a particular gender.

But the term that led the parties to completely opposite positions and created the great division was the meaning of gender. Gender, in Article 4, point "ë" of the approved law, is defined as "Gender means the roles constructed in the social context, behaviors, activities and attributes that a given society considers appropriate for men and women."

So gender as a social context and not innate as a synonym for sex. With this concept, it seems as if biological reality is left out and is based on behavior. According to opponents of this law, mainly the opposition, this leaves room for other genders to be added in the future, some say up to 72 and others even more. But the government says that the law clearly defines the binary concept of gender: only man and woman.

Another term that has been shared is that of multiple gender affiliation, which is explained in the law as "The connection and combination of gender with different characteristics provided for in the legislation in force for protection from discrimination."

Some interpret it as an opening for the recognition of more genders, but lawmakers associate this term with cases where a person can be discriminated against for several reasons simultaneously: such as gender, ethnicity, age, disability, or social background.
