Lawyer Spartak Ngjela commented on the measure of arrest against former Prime Minister Berisha. He said that there is no Constitutional violation regarding the measure of arrest against Berisha.
According to the lawyer, the Constitution only prohibits his arrest, which cannot be undertaken without going to Parliament.
"There is no violation of the Constitution.
If it was before the constitutional amendments regarding immunity were made, of course it would be a violation of the Constitution.
Immunity of Berisha, one day before the decision of the Assembly, the Constitutional Court speaks about the legitimacy of the request of SPAK.
But the new Constitution only prohibits arrest, which cannot be undertaken without going to parliament.
Therefore, at the moment when the decision was made to arrest Berisha after he did not appear for questioning, of course the arrest will be made.
