
After the closure of the investigations into the murder of Fatbardh Lici in 2018 in Shkodra, Safet Bajri has submitted several requests to SPAK.
The Special Prosecution Office says it has collected evidence on which it has created reasonable suspicion that the persons under investigation, Behar Bajri, Astmer Bilali and Safet Bajri, planned, organized and committed the murder with firearms of citizen Fatbardh Lici, a relative of citizen Ibrahim Lici.
But in his request, Bajri is asking for his DNA sample to be taken and compared with DNA from the crime scene. He is also asking for the video footage to be reviewed to conclude whether or not his presence can be identified at the scene.
Full request:
First. After being informed of the completion of the investigations and the notification of the charges against my clients, we request from the proceeding body a copy of all acts of the investigative file for criminal proceedings no. 112\2019 for the defendant Safet Rustemi, as up to this moment we have not been informed of any act or investigative action carried out, nor of the request for the completion of the investigations.
Secondly. My client Safet Rustemi, after being informed of the accusations and claims of the investigating body for taking him as a defendant, requests that some additional investigations be conducted which we consider important for the case and which will affect the reduction of the difficult position in which my client has been placed.
Specifically, in compliance with the legal deadlines provided for in Article 327 of the Code of Criminal Procedure, point 4, we request that the proceeding body carry out the following actions:
1. Taking a DNA sample from citizen Safet Rustemi and comparing it with DNA taken at the crime scene.
2. Conducting an expert examination of the video footage and providing a response from the expert if it results in my client being identified as a person at the scene or if he cannot be identified.
We consider these actions important and necessary to clarify my client's position in this criminal proceeding.
