Lawyer Bledar Dervishaj has supported the position held by Prosecutor General Olsian Çela regarding the draft of the new Criminal Code.
Çela did not support the changes to the Criminal Code, saying that they risk undermining the functions of justice.
Dervishaj stated that the drafting of this draft was not done with the comprehensive participation of interest groups, not just lawyers, and as such it is not ready to be put to public consultation and not then for a vote.
He brought attention to electoral crimes, the penalty margin for which has been eased in the draft of the new criminal code.
"The fact that the Prosecutor's Office, which is the basic institution related to the penal code, is not called for consultation is worrying. The new penal code in the country is welcome, so we need to change it, Albania's challenges today are different, society has developed and the state has decided to penalize other social behaviors that we cannot conceive. In order to avoid unnecessary debate, there should have been more cooperation and today we would have a more qualitative draft. Lawyers could have been called, but not of the level that a penal code requires. For example, electoral crimes as they have been and as they are, I see a relaxation of penal policy in the margins of punishment. We need to know who was the author of this draft, the government, the school of magistrates? The penal code should consult all the ministries, I do not see the specialized opinion, not only legal but also economic and wider, being distributed. The draft is not yet ready for public consultation, not to be approved because it would be an overthrow of criminal justice ", Dervishaj told "Euronews" "Albania".
