
A court decision that forces the state to pay 500 thousand euros for an accident without life-threatening consequences has aroused the indignation of Prime Minister Rama, who 2 days ago called it a "blunder" of justice.
" We lost a trial in the Appeal Court where the state was asked to pay 500 thousand euros for a car crash 8 years ago, where there were no deaths or injuries, but the driver and co-driver had the vision to sue the state for endangering their lives. The decision was made within a day and the state was hit with 500 thousand euros ," said Rama.
The decision for which Rama accuses the justice system was given by the judge of Vlora, Hektor Sinanaj, in December 2020 and was also upheld by the judge of Appeal in Tirana, Marsela Dervishi, this month. It concerns an accident that occurred in August 2017, at the construction site of the Vlora-Peshkëpi road, where 6 women, relatives of each other, were involved. Eglantina Demiraj, a passenger in the first place, was injured, while the others escaped without injury. The car driven by Nikoll Kacaj went off the road and ended up in a canal.
The decision of the Vlora Court, which Report TV has managed to obtain, states that the injured Eglantina Demiraj suffered spinal injuries, difficulty moving her legs, which resulted in a temporary loss of ability to work. According to the court, the accident was a result of roadworks and the lack of signage.
The defendant, and which according to the court's decision will have to pay the compensation, is the Albanian Development Fund, despite the fact that the road works were entrusted to a private company. In the reasoned decision of the Vlora Court, announced on December 24, 2020, the blame falls on the Fund, since "the Construction Permit has been issued in the name of this institution, and that it is considered responsible for the development of the project, its supervision and implementation.
