
Judge Hazbi Balliu has been assigned by lot to review the lawsuit of the Mayor of Tirana, Erion Veliaj, at the Administrative Court.
The mayor is seeking the invalidation of the appointment of special prosecutor Olsi Dado.
Through the lawsuit, Veliaj seeks to establish the absolute invalidity of the 2008 decree appointing Ols Dado as a prosecutor, at a time when the law did not allow this without first completing the Magistrate's School, as he was a notary.
According to the lawsuit, the appointment was made in flagrant violation of the law, as at the time of the decree, Ols Dado did not meet the mandatory legal criteria for exercising the function of prosecutor, due to the lack of relevant education at the Magistrates' School.
Veliaj also requests that the High Prosecutorial Council be forced to make a decision on the immediate termination of the magistrate's status and the exercise, according to him, of the prosecutor's duty by Ols Dado.
The lawsuit emphasizes that all criminal actions taken against Erion Veliaj, including security measures and the limitation of the exercise of the mandate of the Mayor of Tirana, are based on an appointment act considered "nul ab initio", bringing serious consequences to the Municipality of Tirana, the Republic of Albania, the constitutional order, institutions, as well as his family and person.
According to the lawsuit, Ols Dado was proposed to the Presidency in 2008 by the then Prosecutor General, Ina Rama, while he did not meet the legal requirements, as he was only a notary and had not completed the Magistrate's School. Despite this, the Presidency decreed his appointment as prosecutor.
Judge Balliu was recently targeted by accusations from Prime Minister Edi Rama.
Rama even, referring to a decision by Judge Balliu, said that he has been placed in a trench with the lawless.
