After escaping, former Chief Prosecutor Adriatik Llalla made another maneuver to never be put in jail.
He has waived his recourse to the Supreme Court, where he appealed the Appeals Court decision, which sentenced him to 2 years in prison for concealing assets.
This waiver of recourse comes at a time when the Supreme Court has announced the trial date four years after Adriatik Llalla's conviction, but also very likely as the statute of limitations approaches. The Supreme Court has announced that the trial date will be March 25 and will be heard by senior judge Ilir Panda. But with the waiver of recourse, it is expected that the court will be left without a case to consider.
This is a strategic move by Adriatik Llalla, as his sentence is time-barred for 2 years. He was sentenced in 2021 to 2 years in prison and according to the Criminal Code, for sentences of this nature, the sentence is time-barred after 5 years. So in May 2027, Llalla cannot be arrested. He will be considered convicted, but he will not serve a single day in prison.
" The sentence shall not be executed when, from the day it became final, the following have passed: a) twenty years for a sentence of fifteen to twenty-five years' imprisonment; b) ten years for a sentence of five to fifteen years' imprisonment; c) five years for sentences of up to five years' imprisonment or other lighter sentences ," the Criminal Code states.
His fear was that the Supreme Court could return the file for reconsideration and anything could happen after that. It seems Llalla has decided to stop the battle and enjoy the escape for another 2 years.
A few weeks ago, he appeared at a rally held by DP leader Sali Berisha in Italy, which proves that Llalla has hopes that the DP will come to power and then there will be no more problems.
Adriatik Llalla was elected Prosecutor General in 2012 and held this position until November 2017, when his 5-year mandate ended.
Investigations against him began in 2018 on charges of concealing assets, abuse of office, and money laundering. He was also investigated for the criminal offense of "failing to declare monetary amounts at the border."
Subsequently, the file was sent to the former Serious Crimes Prosecutor's Office and in July 2018, the respective court ordered the seizure of the former Prosecutor General's properties.
In a press release at the time, the Serious Crimes Prosecution announced that Llalla's 67 square meter apartment in Durrës and four plots of land with a total area of about 22 thousand square meters on the outskirts of Tirana were placed under seizure.
The charges against Llalla were dropped and SPAK announced on March 9, 2021 the conclusion of the investigations only for the criminal offense of "refusal to declare, failure to declare, concealment or false declaration of assets, private interests of elected persons and public servants or of any other person who has a legal obligation to declare", committed three times.
On May 20, 2021, Llalla was sentenced in the first instance to 2 years in prison. He will benefit from the application of the shortened trial, reducing the sentence by 1/3, leaving the final sentence at 1 year and 4 months in prison. /Pamphlet
