The Mandatory Health Insurance Fund is seeking the termination of contracts with approximately 360 pharmacies that provide reimbursed medicines to patients, as well as the pursuit of criminal proceedings against some of them on the grounds of fictitious invoices for nearly 10 medicines.
A report sent to some of the pharmacies states the termination of the contract without a fixed term. Following this order, the Order of Pharmacists reacted, considering this action as a massive collective punishment without evidence and which should be immediately withdrawn by the fund's managers, as it not only includes almost all pharmacies that have contact with this institution, but also causes the collapse of the pharmaceutical system with consequences for patients who benefit from reimbursed medicines.
The Order's official statement emphasizes that the minutes were drafted unilaterally without relying on the control regulation and, moreover, the minutes do not contain the signature of the head.
The claim about the existence of fictitious invoices is unfounded, as pharmacies are supplied only by importers and distributors contracted with the Fund. The invoice issued by the warehouse, generated and registered in the e-warehouse system, cannot be considered fictitious, as this system does not allow the issuance of an invoice in the absence of the goods in the warehouse.
The pharmacy has no competence and no technical-legal possibility to verify the physical condition of the medicines in the warehouse, a responsibility that belongs to the Fund and its control structures.
The statement also emphasizes that this procedure jeopardizes the uninterrupted supply of patients with medicines and the stability of the pharmaceutical service as a whole.
This collective and unfounded punishment creates a dangerous precedent for the continuation of the contractual relationship between the Fund and the Pharmacy.
Almost all pharmacies that have received these letters have been previously checked by the Regional Directorates and by the Fund itself, with a physical inventory of the relevant drugs, without the alleged violations being found. Under these conditions, in order to avoid a collapse in the supply of patients with reimbursable drugs, which could result from massive penalties or a collective reaction by pharmacists, we request that any administrative procedure or action be terminated.
The statement also emphasizes that the Order of Pharmacists of Albania is against any form of abuse or illegal benefit from anyone, but cannot and will not accept collective penalties, arbitrary actions or criminal threats without evidence and without legal procedure, which violate the profession, pharmacies and the public interest. Therefore, they request the immediate intervention of the Ministry of Health to resolve this situation. /Top Channel
