The horrific death of 3-year-old Brian Spahiu after a dental procedure in Tirana has led to the first legal measures being taken against the doctors involved in this serious incident.
The Tirana Prosecutor's Office has issued security measures for five people, suspected of "negligent homicide", "fraud in collaboration" and "abuse of office", while two other doctors have been taken under investigation for negligence in medical treatment.
At the center of the investigation is the dental intervention that was performed on the minor on September 28, 2023, at the private clinic "Splendent", where he underwent aggressive treatment on 14 teeth, under general anesthesia for about 5 hours. Just a few hours after the intervention, the child fell into a coma and was admitted to the QSUT, where he died on October 1. The Italian expertise conducted at the request of the Albanian Prosecutor's Office has confirmed that the dental intervention was excessively extensive and outside any protocol allowed for a child of this age. Furthermore, he had not received an accurate diagnosis, nor had the necessary tests been performed before the operation.
The doctors responsible, Roland Xhaxho and his daughter Ina Xhaxho, face serious charges, while they and their collaborator Marta Gina have been placed under house arrest, even though the prosecution requested "prison arrest." The court has refused to arrest them.
Serious violations were also found in the autopsy and initial expertise by the Institute of Forensic Medicine, as well as in the post-intervention treatment provided by the Pediatric resuscitators at the QSUT. This has led to the investigation of two other doctors, VH and DS, for medical negligence.
The case of Brian Spahiu has exposed a frightening spiral of negligence, irresponsibility and, according to the Prosecutor's Office, even deliberate fraud in the public and private healthcare system. Not only medical protocols have been violated, but also the very minimum principles of care for human life, especially when it comes to a 3-year-old child. The case requires criminal and institutional responsibility, and cannot be covered up with silence or lenient court decisions.
Announcement of the prosecution
The prosecution at the Court of First Instance of General Jurisdiction, Tirana, has issued security measures for five persons for the criminal offenses of 'Murder by negligence', 'Fraud in collaboration' and 'Abuse of office' in the framework of the investigations into the case of the death of a 3-year-old minor after a dental intervention in a clinic in the capital. The prosecution, following the investigations initiated on criminal proceedings no. 6477, dated 05.10.2023, has taken the following citizens under investigation:
1 – R. Xh., për kryerjen e veprës penale “Vrasje nga pakujdesia”, parashikuar nga neni 85 i K.Penal si dhe për veprën penale të parashikuar nga neni 180/a i Kodit Penal. Mbi bazën e kërkesës së prokurorit, gjykata vendosi masën e sigurimit “Arrestit në shtëpi”, të parashikuar nga neni 237 i Kodit të Procedurës Penale;
2 – I.Xh., e dyshuar për kryerjen e veprës penale “Vrasje nga pakujdesia”, parashikuar nga neni 85 i K.Penal dhe “Mashtrim”, kryer në bashkëpunim, parashikuar nga neni 143/2 i K.Penal;
3- M. G., e dyshuar për kryerjen e veprës penale “Vrasje nga pakujdesia”, parashikuar nga neni 85 i K.Penal dhe “Mashtrim”, kryer në bashkëpunim, parashikuar nga neni 143/2 i K.Penal;
4 – E.S., i dyshuar për kryerjen e veprës penale “Shpërdorimi i detyrës”, kryer në bashkëpunim, parashikuar nga nenet 248 dhe 25 i K.Penal; dhe
5 – E. A, i dyshuar për kryerjen e veprës penale “Shpërdorimi i detyrës”, kryer në bashkëpunim, parashikuar nga nenet 248 dhe 25 i K.Penal.
Nga ana e prokurorit u kërkua masa e sigurimit ‘Arrest në burg” për personat nën hetim I. Xh. dhe M. G. ndërsa gjykata ka vendosur masën e sigurimit “Arrest në shtëpi”, të parashikuar nga neni 237 i Kodit të Procedurës Penale.
Në vijim të hetimeve që lidhen me ngjarjen e datës 28.09.2023, kur i miturit B.S, i moshës 3 vjec, i është nënshtruar një ndërhyrje dentare në 14 dhëmbë, tek Klinika “Splendent” drejtuar nga mjekët R.Xh dhe I. Xh. I mituri pas ndërhyrjes kthehet në shtëpi dhe brenda pak orësh dërgohet në gjendje të rëndë shëndetësore (koma dhe insuficencë respiratore akute), në Spitalin e Pediatrisë në Qëndrën Spitalore “Nënë Tereza”, Tiranë, ku dhe më pas në datën 01.10.2023, ka ndërruar jetë.
Për shkak të mangësive dhe konkluzionit të paargumentuar në aktin e ekspertimit mjekoligjor të kryer nga ekspertët e I.M.L.-së, nga ana e prokurorit të çështjes Alma Felaj, për një hetim të plotë, të gjithanshem e objektiv të çështjes penale, në datën 10.12.2023, u vendos kryerja e riekspertimit mjekoligjor dhe ekspertimit mjekoligjor shtesë multidisiplinar me grup ekspertësh. Për këtë qëllim u kërkua ndihmë juridike autoriteteve italiane të drejtësisë, duke kërkuar kryerjen e riekspertimit mjekoligjor dhe ekspertimit mjekoligjor shtesë multidisiplinar me grup ekspertësh në shtetin italian.
Sipas aktit të riekspertimit mjekoligjor dhe ekspertimit mjekoligjor shtesë, nga ana e grupit ekspertëve italianë u arrit në konkluzionin se:
Shoku septik i rëndë, që solli më pas insufiçencën progresive shumëorganore, është shkaku kryesor i vdekjes të pacientit të mitur B. S. Grupi i ekspertëve arriti në përfundimin se gjatë ndërhyrjes dentare dhe procedurës së anestezisë, nga ana e anestezistit dhe stomatologeve që kanë trajtuar të miturin, janë konstatuar shkelje të rënda të protokolleve mjekësore ndërkombëtare dhe praktikave më të mira mjekësore, të cilat kanë një lidhje shkakësore të drejtpërdrejtë me vdekjen e tij. Këto shkelje kanë konstatuar në:
– failure to implement, perform the necessary checks and verifications to accurately identify the patient's clinical condition before surgery; failure to adequately formulate the diagnosis before surgery and failure to provide appropriate prophylactic treatment before surgery and subsequently, the minor underwent a surgical procedure without being adequately examined, without an accurate diagnosis, without a justified indication, without specifying alternatives and without performing the necessary and mandatory tests for the patient's clinical condition;
– the intervention performed, which was more extensive than allowed for a 3-year-old child and the induction of general anesthesia for a period of about 5 hours, to simultaneously treat many teeth, including some with pulp infection with the risks associated with general anesthesia and the difficult control of postoperative infections, highlights the responsibility for overtreatment
– the completely inappropriate discharge of the minor from the hospital, also not taking into account the risks associated with anesthesia and the pathologies from which the child was suffering, and especially the reasons for the prolonged awakening time after the intervention, as well as other clinical signs.
The Italian expert group has found serious violations of medical protocols in the conduct of the autopsy and forensic examination by the IML experts, citizens ES and EA.
The Italian expert group also found violations of medical protocols by the pediatric resuscitation doctors who treated the minor BS.
Based on this fact, the prosecution has taken as persons under investigation citizens V. H and D. S, doctors in intensive care at the Pediatrics Department at the University Hospital, suspected of committing the criminal offense of "Neglect in medical treatment" provided for in Article 96/1 of the Criminal Code.
