The Court of Appeal has left in prison Eridon Muho, who is suspected of helping the dovecote Armando Nelaj to put explosives on the ship a few weeks ago in the port of Saranda. Also, Muho had planned with Nelay to put the explosives on a ship, for competition reasons. But the explosive accidentally detonated the 52-year-old Nelaj, during the attempt to transport him and put him on the ship, where he died as a result.
The Appeal decision came after Muho requested the change of the security measure imposed by the Court of First Instance of General Jurisdiction Saranda.
"In the Court of First Instance of the General Jurisdiction of Sarandë, a trial was held regarding the legal evaluation of the detention and the determination of the security measure "arrest in prison" against the person under investigation with the initials E. M, suspected of committing the criminal offense "Destruction of property with explosives", committed in collaboration and remaining in the attempt, provided by article 152/3, 25 and 22 of the Criminal Code.
At the end of the trial, the Court of First Instance of General Jurisdiction Saranda, with decision no. 23-2024-1488, dated 30.07.2024, has decided: The legal assessment of the detention of the person under investigation EM The appointment as a security measure against the person under investigation E. M that of "arrest in prison", provided for by article 238 of K .Pr. Criminal.
The case on appeal was examined on the basis of the appeal made by the person under investigation with the initials E. M, who requested the change of the Court's decision and the revocation of the request of the prosecution body. At the end of the trial, on 13.08.2024, the Court of Appeal of General Jurisdiction, composed of the panel with Judge Relator Mr. Qemal Zaimi, decided: Approval of the criminal decision No. 23-2024-1488 dated 30.07.2024 of the Court of First Instance of the General Jurisdiction of Saranda", the court announces.
