The Special Court of Appeal for Corruption and Organized Crime has today upheld the decision of the Court of First Instance to keep Robert Myftari in prison. The latter was sentenced to 10 years in prison for drug trafficking and participation in a criminal group.
Myftari was arrested in Rinas on September 23, 2025, after being declared wanted by SPAK, along with others, for the "Spirit" file developed in July 2021.
In the group accused by SPAK, there were also five public officials, including the prosecutor of Vlora, Maksim Sota and Ilirjan Balla, former head of traffic at the State Police, Artur Krasniqi, Festim Lelaj, all state officials accused of abuse of office.
Announcement of the GJKKO
The Special Court of Appeal for Corruption and Organized Crime, with a panel composed of judges Dhimitër Lara (presiding), Daniela Shirka (member) and Tereza Merkaj (member), today on 22.01.2026, announced the decision on criminal case no. 13/78 act, date 24.12.2025 registration, on the appeal of the defendant RM, against decision no. 64, date 17.10.2025, of the Special Court of First Instance for Corruption and Organized Crime, disposed as follows:
"1. The guilty plea of the defendant RM for the criminal offenses "Drug trafficking", in collaboration, within the framework of a structured criminal group, remaining in attempts, provided for by articles 183/a1 and 22, 23, 27, 28/4 of the Criminal Code and based on article 334/1 of the Criminal Code, his sentence to 10 (ten) years of imprisonment.
- The guilty plea of the defendant RM for the criminal offense of "Structured criminal group", provided for by Article 333/a/2 of the Criminal Code and his sentence to 2 (two) years of imprisonment.
- In application of Article 55 of the Criminal Code, in determining sentences for several criminal offenses, the sentencing of the defendant RM to a single sentence of 10 (ten) years of imprisonment.
- The serving of the sentence for the defendant RM begins from the day of his arrest for the purpose of these proceedings.
- In application of Article 15 of Law No. 81/2020, "On the rights and treatment of prisoners and detainees", the defendant RM shall serve his sentence in a high-security prison.
- In accordance with Article 36, point 1, letter “b” of the Criminal Code, 190/1, letter “a” of the Code of Criminal Procedure, the floating vessel, type dinghy, with the name “****”, registration number ****, in the name of citizen RM, seized in November 2015 by the Albanian police with a load of about 800 kg of narcotics and subsequently registered in the name of citizen MD, son of co-defendant ID, shall be confiscated and transferred to the state.
- Court costs are charged to the defendant RM
- An appeal against this decision is allowed to the Special Court of Appeal for Corruption and Organized Crime within 15 days from the day after the notification of the decision.”
In conclusion, the Special Court of Appeal for Corruption and Organized Crime
decided:
- Leaving into force decision no. 64, dated 17.10.2025, of the Special Court of First Instance
First on Corruption and Organized Crime.
- The procedural costs of the appeal trial are borne by the appellant.
