"Balluku" case, Presidency: We support the decision of the

The Presidency has expressed support for the Constitutional Court's decision, whatever it may be, in the case of Deputy Prime Minister Belinda Balluku.

The Presidency says that the measure taken by the GJKKO and SPAK to suspend the Deputy Prime Minister and Minister of Infrastructure and Energy from office is unconstitutional.

During the session, the representative of the Presidency stated that this institution is involved in the matter because it has the authority to decree the appointment and dismissal of members of the Council of Ministers.

"If the prohibitory measure of suspension from the exercise of a duty or service, imposed on a member of the Council of Ministers or the entire Council of Ministers, affects the free and unconditional functioning of the executive branch, then this measure takes on the content of an instrument of control and balance between the powers. Such an instrument which is not provided for by the constitution, but which has the legal force to condition the functioning and composition of the executive branch and cannot be considered constitutional.

"If the prohibitory measure does not affect the free and unconditional functioning of the executive branch because the legal framework in force provides for institutional solutions or workarounds that do not create an impact on the executive branch and do not place it before forced movements, then it leaves the criminal context and does not become an instrument of checks and balances of the judicial branch over the executive branch ," said the representative of the Presidency.
