
Lawyer Sokol Hazizaj has commented on the decision of the Constitutional Court that he gave today against the former Prime Minister Sali Berisha, regarding the two security measures applied to him, avoiding the Assembly.
" The Constitutional Court has considered the measure of "obligation to appear" against former Prime Minister Sali Berisha to be completely legal, but overturned the measure of "prohibition of exiting the country".
This decision of the Constitutional Court does not change the security measure that Sali Berisha has today, so he remains under house arrest.
But this decision has a positive element, it is not regressive in its entirety, despite the negative variety, it brings a novelty of changing the security measure. So when a measure of "prohibition of exiting the country" is considered "non-proportional", it may happen that in the future trials, we have a change of the current measure of insurance against Mr. Berisha ", said Hazizaj on the show "Open" on News24.
He stated that the decision of the Constitutional Court does not fully comply with the role that this Court should play. " The Constitutionalist should have stated clearly: the measure of the "ban on leaving the country" is anti-Constitutional. The Constitutional Court cannot comment on non-proportional measures ," said Hazizaj.
