For 20 years, the company has benefited from 100% of profits and tax exemption, while ministers, "Albpetrol" and customs have covered up the financial super-crime that is still kept away from SPAK.
The investigations so far by the Fier Prosecutor's Office into the economic-financial crimes of the concession company "Bankers" in the oil sector, during 20 years of activity in Albania, have as evidence the theft of 5 billion euros in fiscal obligations to the state.
Although arrest warrants have been issued for several leaders of "Bankers", so far no ministry officials have been prosecuted, nor officials of "Albpetrol", Taxes or Customs - the structures that created the terrain and favoritism for the "Bankers" mafia, allowing them to evade taxes, profit tax and falsify import-export balances.
2004 contract: total exemptions
In the concession contract dated June 19, 2004, signed by "Albpetrol" and the Ministry of Economy with the offshore company "Saxon International Energy Ltd." (Bankers), the latter was given the right to receive 100% of the income and profits from the extraction and sale of oil.
Article 13 of the contract stipulates that “Albpetrol” has no beneficial interest in the oil-extracting area granted by concession. Furthermore, the contractor, its subsidiaries, subcontractors and their foreign personnel are exempt from any taxes and customs duties in Albania, except for the minimum fees for oil storage at the port.
Also, foreign employees of "Bankers" and its subcontractors do not pay any taxes.
for personal income, profits or the import and re-export of their assets and belongings. In Article 14, the Albanian government has defined another favor: the contractor and subcontractors are allowed to import without customs duties equipment, machinery, raw materials and any material used for oil extraction.
Losses for the state
According to data from the Ministry of Finance, Taxes, Customs and the Natural Resources Agency, it turns out that "Bankers" has not paid an average of 110 million euros per year in fiscal obligations, causing the state treasury a loss of 2.2 billion euros in 20 years.
But the real figure is even higher, as the investigation revealed that the company conducted research, drilling and oil extraction outside the contract area, opening 113 new wells in state reserve areas, with the knowledge and permission of "Albpetrol", the relevant ministry and responsible agencies.
Secret contract extension
A secret bargain between government leaders and the company to extend the concession contract for another five years, until May 2029, has also been discovered.
Why is the file kept in Fier and not in SPAK?
This evidence proves the involvement of high-ranking officials in this financial super-crime. This is precisely the reason why the "Bankers" file is still held by the Fier Prosecutor's Office and has not been passed on to SPAK, although only this structure has the legal competence to investigate an affair of this magnitude./ Pamphlet
