The US-EU partners, who installed and oversee the new justice, are concerned about debunking arrest warrants before they are executed, resulting in the escape of persons.
The practice is this: Decisions are made within the SPAK-Special Court, but are sent for implementation to the Police, which is a structure outside of them and subordinate to the Prime Minister and the Minister of the Interior, where due to the functioning chain, arrest warrants are learned by several bosses.
In order to cut this "line" of notification of arrests, the FBI and EUROJUST have asked the Albanian institutions to create a special police structure within the SPAK of the Special Court, to implement arrest warrants with a closed cycle and with "zero" knowledge. outside of them.
Therefore, the arrest warrants issued by the SPAK and the Special Court should not be implemented by the State Police with its agents and groups, but by a "hermetic" police force, which should be created in the SPAK and the Court and only subordinate to them.
The proposal is based on the model of the US-EU Justice Executive Task Force, according to which, arrests are made only by them, without passing the decisions to a chain of offices outside the structure of justice, after the information flows in advance and the actions fail.
The concern is this: many arrests of criminals, officials, businessmen and individuals connected to the heads of power, escape before the police arrest them; which means that they are notified in advance, while the responsibility of deconspiracy is played "ping-pong" between institutions.
For example, on December 14, 2021, when he was arrested, Lefter Koka said: - I could have escaped, because I knew that I would be arrested, maybe some friends informed me as soon as the SPAK order came out and as soon as the order went to the police.
Adriatik Llalla was also released by SPAK, although he had given the claim for 2 years in prison, but the day before the arrest order he escaped, while mutual accusations began between SPAK and the Police for de-conspiracy of the action.
Copy of the deconspiracy is the case of Klodian Zoto, Mirel Mërtir and Stela Gugallja of the landfills, who escaped 2 days before the arrest, informed by the police that they had received the arrest warrant from SPAK, but did not implement it until they left.
