
The arrests of Patos-Marinza are not enough. The investigation must go all the way to the contracts, subcontractors, fiscal obligations and the political chain that approved them...
SPAK has arrested executives of “Bankers Petroleum”. This does not close the accounts with oil. Contracts, fiscal favoritism and suspected spending schemes require full verification. The investigation should include AKBN, Albpetrol, customs, taxes, municipalities in the area and the political decision-making that has allowed them.
The arrests at Bankers Petroleum open a door that politics has kept closed for three decades. SPAK put the company's CEO, Hongping Xiao, in handcuffs.
The dossier talks about the abuse of the country's greatest natural resource. This is the starting point, not the end. If the investigation stops at a group of leaders, society will receive a farce, not justice.
The contracts that governments have signed for Patos-Marinza and other oil fields determine public and private profit. These contracts have provided fiscal advantages, tax relief and room for maneuver with reported expenses for years. AKBN and Albpetrol have been tasked with monitoring implementation, production, expenses and liabilities. Customs and taxes have been tasked with controlling the quantity, export price, invoices and VAT. Municipalities in the area have benefited from local taxes and donations. No link can remain outside the investigation.
The schemes that need to be proven with documents are clear. Were operating expenses and investments inflated to reduce taxable profit? Were related subcontractors used to extract money from the company? Was the declaration of quantities, prices and energy costs manipulated? Were funds diverted for donations, sponsorships and payments for services that disguise political rewards? These questions are answered only with financial, technical and legal expertise on every invoice, contract and customs declaration.
Political responsibility is not outside the scheme. Decisions on concessions, renegotiations, tax forgiveness, tariff changes and customs exemptions have been signed by ministers and governments since 1994. The names have changed, but the logic has remained the same: governments have maintained contracts that give the operator wide latitude and the state few real means of control. If the investigation does not go into this chain of signatures, we risk a simplified version of the truth.
SPAK should do three things without delay. First, partial suspension of the activity that creates ongoing damage and the appointment of judicial administrators in critical parts, if the risk of loss of evidence and property is proven. Second, seizure of complete documentation: balance sheets, subcontractor books, supply agreements, customs declarations, bank agreements and technical reports of production well by well. Third, independent audit of costs and production, with oil experts, financial and contract lawyers who have no conflict of interest with the industry.
If the authorities prove that contracts have been implemented to the detriment of the state, then the government must renegotiate the terms or apply the remedies provided: penalties, contract termination, transfer under public administration and open international auction with new conditions. If the documents prove that fiscal obligations have not been paid, taxes and customs must immediately calculate the principal, interests and fines and impose security measures on the assets.
This investigation cannot be closed at Patos-Marinza. The same control must be carried out at Cakran-Mollaj, Gorisht, Ballsh-Hekal, Delvinë, at the chrome and copper deposits, as well as at the processing and export chain. Only in this way do we get a real picture of the harmfulness, only in this way do we return public revenues to the budget, only in this way do we establish criminal and civil liability.
Albania does not have the luxury of a facade of justice. If the first arrests turn into soft deals and a return to the status quo, we will have lost the only opportunity to close a long chapter of abuses. SPAK must bring the chain of money and the chain of firms to the end. Only in this way will this investigation become justice, not a political scenario./ Pamphlet
