The Ministry of Justice is preparing to add 200 new licenses for notaries and private bailiffs, despite the fact that the current number of offices exceeds the ratio provided for in the law to the population. According to the Law on Notaries and the Law on Bailiff Service, quotas are determined based on the number of residents declared by the Census. Currently, about 410 notary offices and 187 bailiff offices operate, while new projects foresee a significant increase. The issue has raised debate on compliance with legal criteria and the transparency of the licensing process.

With the appointment of Besfort Lamallari as head of the Ministry of Justice, Edi Rama did not refer to his professional skills, but to his willingness to sign the documents presented to him, as happened during the time he served in the Ministry of Interior.

After appointing several associates to the Ministry of Justice and its subordinate central institutions, Minister Besfort Lamallari has initiated procedures for increasing licenses for private business services.

According to the information, the minister, in coordination with the leaders of the Chamber of Notaries and the Chamber of Private Bailiffs, has ordered the initiation of procedures to increase the number of notaries and private bailiffs.

Sources say that the Ministry of Justice aims to license 110 more notary offices and 90 private enforcement offices, exceeding the number specified in the relevant laws, which provide for licensing by testing and in relation to the number of population.

Article 10 of Law No. 110, dated December 20, 2018 "On Notaries", stipulates that there must be one notary office for every 15 thousand inhabitants, according to Census data.

According to this criterion, around 160 notary offices should operate in Albania, distributed according to the number of inhabitants. Currently, around 410 notary offices are reported, while the addition of another 110 offices is foreseen.

Law No. 26, dated May 8, 2019 "On the Private Judicial Enforcement Service", provides for one enforcement office for every 20 thousand inhabitants. Currently, 187 private enforcement offices are operating, while the aim is to add 90 new offices.

The issue of licenses for notaries and bailiffs has been the subject of debate in the past, during various governments, where concerns have been raised about the manner in which they are issued and about respecting legal quotas.
