Before 1 month, the Commissioner for the Protection of Personal Data received 3 complaints, in which it was said that in the lobbies, rooms, common areas and the environments inside and outside the "Hotel-Resort Palace Sara-El Durrës" of Luan Bregasi, have found illegal surveillance cameras.
A working group of the Commissioner for Personal Data has verified the denunciations and realized that it is true, that in the "Hotel-Resort Palace Sara El-Durrës" of Luan Bregasi, there continue to be hidden and illegal surveillance cameras in the rooms, in restaurant and cafe, parking lot and outdoor entertaining and relaxing environments, with which he has created an electronic archive.
We say that there continue to be illegal surveillance cameras, because this crime against the privacy of customers who go to rest, or spend a few hours at the "Hotel Palace Sara-El Durrës" of Luan Bregasi, was established as early as November 2016 by the Data Commissioner Personal.
In Decision-Recommendation No. 30, no. 1101/3 Prot., dated November 16, 2016, Chief Commissioner Besnik Dervishaj, says that after the denunciations made by some customers in August-September 2016, the investigative group discovered that in the collective and individual environments and the external environments of "Hotel Palace Spa Sara -El Durrës", there were illegally installed and hidden surveillance cameras.
While the owner Luan Bregasi, based on the legal obligation, had declared only the cameras located in visible places for the external physical inspection of the hotel building; in violation of the law on personal data, he had placed hidden cameras inside the hotel and in the rooms and showers, even in the Presidential Suite and 5 "VIP" suites.
Por Luan Bregasi, ka vendosur kamera të fshehta dhe në mjediset e punës e ato personale të punonjësve të hotelit, duke mos i vënë në dijeni ata; ndërsa në raport hetimin e komisionerit, citohen këto fakte krimesh përgjimi ilegal që bëhen në “Hotel Palaçe S.p.a. Sara-El Durrës”:
1. Kontrolluesi (pronar Luan Bregasi), aplikon mbikëqyrjen e ambienteve me sistem video-vëzhgimi, pa vendosur në mjedise e hotelit, tabelat informuese me tekst: “Mjediset vrojtohen”.
2. Vrojton me kamera punonjësit, pa i vënë në dijeni e pa nënshkruar me ta deklarata pranuese.
3. Në hotel e Luan Bregasit, është gjetur një arkiv elektronik me të dhënat personale të krejt klientëve që kanë qenë në “Hotel Palace Sara-El Durrës”, krijuar në mënyrë ilegale e të paligjshme, duke tejkaluar ligjin dhe qëllimin e regjistrimit të tyre.
Në vendim, Luan Bregasit iu la detyrë që arkiva me përgjimet e klientëve dhe punonjësve të hotelit, të asgjësohej brenda 10 ditësh më 16 dhjetor 2016, në prezencë të grupit të hetimit..
Por hetimi teknik që iu bë para 1 muaji, zbuloi se Luan Bregasi jo vetëm nuk e ka asgjësuar arkivin me përgjimet e klientëve dhe punonjësve, por nuk ka hequr as kamerat e fshehta dhe prej 7 vitesh vazhdon përgjimet e tyre në mënyrë të fshehtë e kriminale.
Ndërsa Krye Komisioneri Besnik Dervishaj, nuk po e kallëzon penalisht “çimkën” Luan Bregasi për këtë krim, drejtësia duhet të zbulojë, se cilët janë klientët e njohur të botës së biznesit, drejtësisë, pushtetit, politikës e krimit, që ai ka përgjuar dhe të dhënat e tyre intime i ka përdorur për presione e përfitime personale.
