The decision for the former Mayor of Patos, Rajmonda Balilaj, is another case that shows that the SPAK and the Special Court act with two standards in fighting the corruption of officials.
On March 9, 2024, at the request of SPAK and the decision of the court, the Prefect of Fier District, Rajmonda Balilaj, was suspended from office, on the charge that when she was mayor, she committed the criminal offense of corruption and favoritism in tenders.
The decision against former mayor Rajmonda Balilaj of Patos, compared to the decisions for other mayors; shows that SPAK and the Special Court operate with two standards in criminal measures, creating suspicions of clientelistic and political influences on the new justice system.
FIRST CASE/ The Mayor of Lushnja, the socialist Fatos Tushe, was arrested on July 6, 2021 in office, only for 1 case of canal cleaning tender worth 24 million ALL, with the charge of negligence in the control of procedures.
But the prison arrest was investigated and he was sentenced to 2.4 years in prison, while after his full release from prison, SPAK and the Special Court of Appeal re-sentenced him to 1 year in prison.
SECOND CASE/ On March 16, 2023, SPAK and the Special Court arrested the Mayor of Bulqiza, the socialist Lefter Alla, on the charge of corruption in the water supply tender, which was investigated and sentenced to 2 years in prison.
In these two cases, referring to the charges raised, SPAK and the Special Court have arrested on duty, investigated to the extent of imprisonment and sentenced the former Mayor of Lushnje Municipality, Fatos Tushe and of Bulqizë Municipality, Lefter Alla.
While for the same criminal offenses as these, SPAK and the Special Court did not arrest the Mayor of Patos, the socialist Rajmonda Balilaj, at the same time Member of the Central Assembly of the SP.
They did not arrest her, not even after June 2023, when she handed over the post of Mayor of Patos, although since then charges had been proven against her and criminal proceedings had begun, while on December 20, 2023, Prime Minister Edi Rama appointed her Prefect of Fier District.
On March 9, 2024, she was suspended from the post of Prefect of the Fier District, when according to the Code of Criminal Procedure, she should have been arrested, as was done with her two socialist colleagues from Lushnja and Bulqiza for the same criminal offenses.
But SPAK and the Special Court only decided to suspend him from office and release him, when suspension from office is not a criminal measure, but an administrative measure that could be implemented by the prime minister, as the official who appointed him./ Pamphlet
