According to the law, the Municipal Council is obliged to meet within 3 calendar days from the day that the mayor Rexh Byberi completed a 3-month absence from office; and through the Prefect of Kukës, to notify Prime Minister Edi Rama, while he must dismiss him and notify the CEC to announce the election of the new president...

On September 9, 2024, SPAK announced the Mayor of Tropoja, Rexh Byberi, under "house arrest" with Decision No. 112, dated September 6, 2024 of the Special Court for Corruption and Organized Crime.

Byberi of Tropoja, was taken as a defendant by SPAK, for the criminal offense "Abuse of duty" according to article 248 provided for up to 7 years in prison; for "Illegal cutting of forests" according to Article 205, 1 year in prison; and "Destruction of property" under Article 150 up to 3 years in prison.

On November 9, 2024, Mayor Rexh Byberaj completed a 3-month absence from office; which means that legally he has lost the mandate of the mayor and elections must be held for a new mayor in Tropoja.

According to point "A", of article 62 of the law, based on his criminal proceedings, Prime Minister Edi Rama should have dismissed the mayor of Tropoja for violating the Constitution, the oath of the law during the exercise of his duties.

But Prime Minister Edi Rama should have dismissed him immediately, when SPAK and GJKKO decided on Rexh Byberi the "house arrest" measure; as Babloku did with the mayor Shukri Xhelili of Dibra, Elvis Roshi of Kavaja, Fatos Tushe of Lushnje and Lefter Alla of Bulqiza.

Whereas in point "C" of Article 62 of the Law on Local Government, it is stated that the Mayor's mandate expires when he does not return to office for 3 consecutive months, for whatever reason.

The mayor of Tropoja, Rexh Buberi, on November 9, 2024, completed 3 consecutive months without appearing for office; even according to point "5" of article 61, he has been replaced by the vice-president and currently has no function in the Municipality of Tropoja, as he is under "house arrest".

According to the law, the Municipal Council is obliged to meet within 3 calendar days from the day that the mayor Rexh Byberi completed his 3-month absence from office; and through the Prefect of Kukësi, to notify Prime Minister Edi Rama, while the latter must dismiss him and notify the CEC to announce the election of the new president.

Mayor Rexh Buberi's mandate ended on November 9, 2024, while the City Council of Tropoja must meet within November 12, 2024 and formally announce the end of his mandate.

In order to save the mandate, the defendant Rexh Byberi got out of house arrest 5 days before the deadline expired and went to the Municipality, but his record is 'nil'; while the police of Tropoja, which has the task of supervising him, did not report to SPAK about the violation of the arrest measure.
