There is no end to the scandals of Rexhe Byber of Tropoja. Even though he is under "house arrest", the tender jambaz continues to defy the law and SPAK.
In addition to instructing his subordinates to give tenders to his family members, the mayor has recently been reported to have broken "house arrest".
Today he appeared in the office, although such a thing is prohibited. It is learned that the reason is to save the mayor's mandate. On December 9, it will be three months since he did not show up for office and this was a precedent for his dismissal according to Article 62 of the Local Government Law.
Byberi is known to have held a meeting with the administration's leaders, and then left. A photo of him with one of the people who participated in the meeting was also posted on Facebook. But the photo quickly disappeared after that.
The Mayor of Tropoja, Rexhë Byberi, has been charged by the SPAK for three criminal offenses and the court has ordered the security measure of "house arrest" against him. He is accused of "Abuse of duty", "Illegal cutting of forests" and "Destruction of property", together with the deputy mayor of the municipality, Abedin Kërnaja.
According to SPAK, from the procedural actions carried out up to this stage of the investigation, there are reasonable doubts that both officials have committed actions/inactions that constitute a regular failure to fulfill their duty, committed in violation of Article 11 No. 408, dated 13.5.2015 "On the approval of the territory development regulation", during the process for opening roads according to the projects approved by the Municipal Council.
According to SPAK, the works for the construction of the roads "Palç-Guri i Lules Ship Station" and "Palç-Guri i Lules Ship Station" were done in violation of legal and by-law acts. "Specifically, for the performance of the works cited above, based on VKM 408 dated 13.05.2015 (amended) for the opening of a new road, the interested entity had to apply in the electronic e-permit system, near the Municipality of Tropoja , as a local institution that has the right to examine and approve the infrastructure construction permit, after having verified the completion of the necessary technical-legal documentation by the applicant who the legislation provides for these types of works. Specifically, in Article 15 of VKM no. 408 dated 13.05.2015 (amended), the technical-legal documents that must be deposited in the e-permit system, during the application of the request for the infrastructure construction permit, have been specified," says SPAK.
From the performance of the act of expertise, it has resulted that the opening of the roads according to the projects approved by the Municipal Council was done in violation of the legal and by-laws in force, causing a damage of 277,611,520 Lek.
Now we have to see if SPAK will ask for a prison sentence, since the law clearly defines that when a security measure is broken, a more severe one is applied. / Pamphlet
