This is not the first time that the lawyer Kostika Çobanaqi does not respect the decisions of DHKASH on boycotts of court sessions by lawyers.
The former judge excluded from justice for 15 years as corrupt, Kostika Çobanaqi, turned lawyer, also known as the lawyer of the oligarch and former accountant Pëllumb Salillari, has broken the decision taken by the National Bar of Albania, not respecting the 3-day boycott of lawyers for Sokol Morning.
The decision to boycott all judicial, civil, criminal and administrative hearings on June 5, 6 and 7 by lawyers was taken on June 4, 2024, at the meeting of the General Council of the Bar Association of Albania, as a sign of solidarity with the violence against colleague Sokol Mêngjesi.
Although the only exceptions to this boycott were requests for security measures, replacement or extinguishment of the measures, lawyer Kostika Çobanaqi represented on Wednesday, June 5, 2024, the oligarch Salillari in a criminal case for "insult/defamation", with the parties : accused Lefter Maliqi and accuser Pëllumb Salillari.
The criminal hearing conducted in the Court of First Instance of the General Jurisdiction Berat by judge Ilirjan Hysa started at 13:00 and ended at 15:30, where the lawyer Kostika Çobanaqi questioned two citizens as witnesses in this trial .
Although the defense lawyer of the citizen Lefter Maliqi did not appear due to the boycott, the lawyer Kostika Çobanaqi requested the continuation of the criminal hearing.
This is not the first time that the lawyer Kostika Çobanaqi does not respect the decisions of DHKASH on boycotts of court sessions by lawyers. Even during the indefinite strike against the new judicial map two years ago, lawyer Çobanaqi participated in several court sessions and was not penalized.
The National Chamber of Advocacy of Albania must take immediate measures against this corrupt lawyer, who until January 2021 held the position of judge in the Court of Berat.
But, due to "corruption" as a judge, Kostika Çobanaqi resigned from his position after the burden of proof was passed to him to prove the opposite of the findings of the administrative investigation.
In the decision of the Independent Qualification Commission, it is stated that judge Kostika Çobanaqi submitted his resignation to the High Judicial Council, after learning about the results of the one-year administrative investigation carried out within the vetting process.
The Independent Qualification Commission, KPK, decided on January 14, 2021 to stop the re-evaluation process and stop the future appointment in the justice system of Berat judge Kostika Çobanaqi, after his resignation from office.
The re-evaluation process for Judge Çobanaqi started in November 2019 and a year later the Commission sent the re-evaluation subject the results of the administrative investigation, passing the burden of proof for the findings.
The decision states that after nearly a month, the KPK was notified by judge Kostika Çobanaqi that he had resigned from his position at the Supreme Judicial Council and that his request was accepted.
After the Commission has confirmed that the subject did not appeal against the decision of the KLGj on ending the status of the magistrate, it summoned him to be heard in a hearing, but Çobanaqi refused to exercise this right.
In conclusion, the court, chaired by Xhensila Pine, with relator Valbona Sanxhaktari and member Lulzim Hamitaj, based on the Annex to the Constitution, decided on January 14 to declare the termination of the re-evaluation process for judge Kostika Çobanaqi and remove his right to be appointed judge or prosecutor of any level, member of the High Judicial Council or the High Prosecution Council, High Inspector of Justice or General Prosecutor, for a period of 15 years.
After being excluded from justice as corrupt, Çobanaqi returned to the courtrooms now as a lawyer and even the lawyer of some of the symbols of corruption and money laundering, such as the oligarch Pëllumb Salillari.
Previously, Kostika Çobanaqi closed Salillar's dirty work as a corrupt judge, while now he has turned into a lawyer for his abusers.
