A possible Democratic victory in the midterm elections could pave the way for multiple investigations and proceedings against the Trump administration.

President Donald Trump is facing a difficult scenario. Democrats have quietly built the most comprehensive infrastructure of preliminary investigations in modern Congressional history. Document preservation requests have been filed, target lists have been compiled, and subpoena strategies have been devised. The machinery is ready and waiting to be activated.

Trump himself has acknowledged what could happen. “If we don’t win the midterm elections, they’ll find a reason to impeach me,” he told Republican lawmakers in January.

With approval ratings below 40 percent, unemployment at 4.3 percent and gas prices up 36 percent since the start of the Iran war, the political terrain has shifted significantly against the Republicans. Prediction markets currently give Democrats an 84 percent chance of taking the House and a 51 percent chance of controlling the Senate, a significant shift in the race for the upper chamber.

But what Democrats can actually do with the power depends entirely on the outcome of the election. If they win only the House of Representatives, they gain subpoena authority and can organize public hearings, tools of political influence. But Republicans in the Senate can dismiss any member of the Cabinet. Charges of disobedience to Congress can drag on in the courts. If Democrats win both chambers, the situation changes radically. The mechanism of investigations becomes a serious threat to the administration.

Arsenal of investigations

Democrats have drawn up detailed oversight plans, demanded the preservation of documents, and compiled lists of targets that include Trump family finances, agency contracts, DOGE operations, and potential violations of the benefits clause. Representative Jamie Raskin told Semafor that “the picture is broad. Our challenge will be how to categorize and synthesize the different levels of corruption and illegality.”

Representative Robert Garcia told The Washington Post that a Democratic majority would “absolutely” demand Trump be interviewed about Jeffrey Epstein. “We want to talk to the president and we have a long list of official calls,” he said.

The targets include communications between the administration and private companies that benefit from federal contracts, financial contributions to Trump properties, funds for the presidential library, and the family's business activities in areas such as drones, defense, cryptocurrencies, real estate, and media.

Representative Rosa DeLauro raised concerns about the firing of members of the Arts Commission and the attacks on suspected drug trafficking ships near Venezuela, highlighting the lack of information. While Sean Casten suggested the possibility of referring these issues to international courts and investigating financial schemes related to cryptocurrencies close to Trump.

The Senate determines everything.

None of these processes went ahead without the Senate. Former Homeland Security Secretary Kristi Noem faced impeachment motions supported by 187 Democrats. Before the process could proceed, Trump fired her on March 5.

Representative Bennie Thompson said it would be a mistake not to pursue the case, while Raskin called the handling of some cases "serious violations." However, with a Republican Senate, these initiatives are likely to fail.

Former Attorney General Pam Bondi also faced charges of obstruction of Congress and breach of trust. Despite a law requiring the release of documents in the Epstein case, millions of pages remain unpublished. Trump fired Bondi on Thursday.

Defense Secretary Pete Hegseth faces serious charges related to military operations. Although some Republican senators have criticized him, a Republican Senate could block any punishment. Otherwise, he would face a real risk of impeachment.

Changing the balance of power

The difference is clear. Disobedience to Congress can be punished by fines and imprisonment. If Democrats control the Senate, these measures can actually be implemented.

The debt ceiling and federal appointments add political clout. A Democratic Senate would have control over hundreds of key positions and influence the budget process and judicial appointments.

Democratic strategist Robert Creamer says the party should focus on the economy if it doesn't secure full control. He points out that voters are looking for concrete solutions to the cost of living.

On the other hand, Republican strategists acknowledge the challenges. Matt Klink and Mike Madrid emphasize that current conditions are among the most unfavorable for a ruling party, while Alex Patton estimates that recovery is difficult without improvements in the economy and public confidence.
