Will Nikola formalize the burning of the mandate in the session of June 24, or will he start the maneuvers of constitutional interpretation?!

Sali Berisha seems to have managed to enjoy the position of DP chairman. After a long court battle, the seal was given to him and there was a great celebration among the Democrats. However, with or without a seal, Berisha's troubles are not over.

If Apeli would leave the seal to Basha, Berisha would not recognize the decision and the same situation would follow. However, in all this enthusiasm, another element has passed in silence, which is perhaps more important than the stamp of the DP: the mandate of the deputy.

With the closing of today's parliamentary session, we can say that legally Sali Berisha has lost his mandate as a deputy. To be more clear. The Constitution in Article 71 point 2 states: " The mandate of the deputy expires or is invalid, as the case may be: a) when he does not take the oath; b) when resigning from the mandate; c) when one of the conditions of ineligibility or incompatibility provided for in articles 69, 70 paragraphs 2 and 3 is proven; ç) when the mandate of the Assembly ends; d) when absent without reason for more than 6 consecutive months in the Assembly; dh) when he is punished by a final court decision for committing a crime ".

The last time Berisha was in the Assembly was December 20, 2023, the day when the parliamentary session closed due to the end-of-year holidays. Then he was isolated in the apartment and the court did not allow him to go out. On June 20, it will be 6 months since he did not go to the Assembly and practically on this date he lost his mandate.

Anyone can say that there are still 8 days left. However, the Assembly gathered in plenary session today and there are no more sessions until the 24th. Due to the start of the European Championship, all the deputies have gone to Germany to follow the National Team and next week will be a break. So, until June 24, Berisha cannot go to the session, which means that practically there is no way to vote to keep the mandate. He is not even part of the parliamentary committees. 

But the formalization of such a thing is in the hands of Rama and Nikola. Will they formalize the burning of the mandate in the June 24 session? Or will the constitutional interpretation maneuvers begin to keep Berisha in the Parliament hall. It remains to be seen, but the signals are that SP has become part of Berisha's bargains.

What raises more doubts is that "non grata" has made a request for interpellation with Rama and this request is seen as a move to go to the session and escape the mandate. It was rejected today, but we may have developments in the coming days. Rama needs Berisha. As long as a "non grata" is at the head of the DP, the SP will continue to win. Also, both of them have cooked all the dirt and continue to cook it. / Pamphlet
