The government has decided to "privatize" the process of awarding tenders. Currently, every public institution enjoys the right to develop tenders, but the government is thinking of bringing the private sector into play as well. So, the procedures of a tender in "X" ministry or institution will be followed by a private company.
This move comes at a time when there have been arrests in the ranks of the majority due to tender abuses. The Secretary General of the Ministry of Health is in prison. Vangjush Dako is also accused of abusing a tender for the promenade on the beach. PIH is also being investigated for an abuse of the mosquito disinfection tender. In short, there have been many abuses in every department and Rama has decided to take measures. The moment the private sector comes into play, they bear the responsibility and the officials get washed away.
More precisely, a state institution that has to carry out a publication procurement procedure may not be directly involved in the development of the tender, but may already entrust it to private companies.
" The contracting of entities, providers of procurement services is decided by the authority or the contracting entity case by case, for objects, where obtaining an external expertise is considered important. In the event that the contracting authority or entity decides to contract a private entity, for its selection it must refer to the procedures provided by the provisions of this law and other legal and by-laws in force", states a draft issued for consultation from the Albanian government.
The fee for performing auxiliary activities for public procurement will be up to 1% of the estimated value of the contract to be procured.
Another point that changes in the law is that for small institutions or those that have less than 15 employees whose tenders, if they are not small purchases, are developed by the superior authorities.
The law also provides for a number of other measures to avoid abuses, which are: -
- Anticipating the development of procurement procedures, making complaints and managing the implementation of contracts using electronic means of communication.
-Exemption from the implementation of the LPP procurement of goods/works/services with a value below the high monetary limit for the needs of diplomatic consular representatives in the Republic of Albania;
- Revision of the Conflict of Interest article, also providing for the case of taking measures in case it is identified during the implementation of the contract;
-Rishikimi i kompetencave të Agjencisë së Prokurimit Publik (në vijim “APP”), të parashikuara në nenin 23 të ligjit, lidhur me monitorimin e kontratave, administrimin e bazës së të dhënave, si dhe rasteve të përjashtimit të operatorëve ekonomikë nga e drejta për të fituar kontrata publike;
-Riformulim i nenit lidhur me blerjen e përqendruar;
-Plotësim i përcaktimit të momentit të skualifikimit të një operatori ekonomik kur është tërhequr nga nënshkrimi i kontratës;
-Saktësim i termit kur një operator ekonomik përjashtohet nga procedurat e prokurimit, ose pjesëmarrja në procedurat e prokurimit apo koncensionit, duke u përcaktuar togfjalëshi “nga e drejta për të fituar kontratat e prokurimit publik, koncesionit/partneritetit publik privat dhe ankandit publik ”;
