There are hundreds of articles that need to be consulted, while issues are referred to the new Criminal Code every day.
For the people in government, this stage with the new Criminal Code is claimed to be the path to the European Union of the new Justice system. More precisely: Albania's Battle Horse for the EU and Rama's remaining pride in the face of the bitter reality of democracy in the country. For the public, the way personalities and interest groups, who serve as the first indicators of quality, have faced it is more than worrying.
The new draft of the Criminal Code presented by the Minister of Justice, Ulsi Manja, on July 25, 2025 and referred to by Mr. Rakipi, claims to qualitatively replace the 1995 Code. As a first defense, the drafters of this draft claim that this undertaking is part of the mandatory reforms of European integration and approximation with the legislation of the European Union (acquis communautaire). But its measure so far proves to be very disappointing.
There are hundreds of articles that need to be consulted, while daily issues are referred to the new Criminal Code. In one of them, for example, it is attempted to decriminalize abuse of office by simply classifying it as a criminal offense. When you think that this “offense” is a cancer for the country, then you are convinced that the Criminal Code needs to be deepened.
While "abuse of office" is considered a criminal offense so far and this has somewhat scared off the offenders who are not lacking. Albania is in dire need of a fair confrontation of the individual with property and especially those who have misused, alienated or knowingly occupied property, to face a harsh law. This is one of the fundamental problems, when you think of the many deaths and the mountain of files in the courts.
Don't go to the media, which makes it anemic and voiceless in the face of power, regardless of the fact that even now in these decades of democracy it is falling more and more. And continuing with many, many problems that show that the drafters know little about the Albanian reality and the subject seems to be translated but not created by studies with genuine scientific analysis. There are who knows how many articles that have had a tough confrontation from specialists and from the Chief Prosecutor of the country and continuing with the President of the Bar Association and other specialists who continue to refer that this code carries many problems.
A Criminal Code shows the reference and reaction of a society, at a certain time, in the face of evil and error, which means that in addition to lawyers and anthropologists, sociologists, teachers, the Academy of Sciences, mathematicians (for the construction of various variables), specialists in various fields of the police, economists, politicians, etc. It would be this corpus that would show the intellectual level of the country in the third decade of the 21st century and the real reference as to which penalties harm Albania and their hierarchy the most.
