
The fact that the opposition not only attacks it but proposes that if it wins, I will ask the Venice Commission to suggest the interventions needed to redo the justice reform. If it controlled it, why would it seek to change it?
The fact that the government has set up the Anticorruption Commission, or as it is otherwise known, the Xhafa Commission, is perceived by domestic and international experts as more of an attempt to limit the work of SPAK than as a contribution to help its work, shows that it does not control it, as otherwise why would the Xhafa Anticorruption Commission be established?
The fact that Mr. Dumani is decorated by the Secretary of State Mr. Blinker and not by the local institutions in Albania is an appreciation not only for the head of the institution but also an encouragement to continue. Let's not forget that they are the main financiers of the reform and they account somewhere for the money spent by American taxpayers. It is not a banana country that can spend money as they wish without being held accountable and audited by supervisory institutions. So the main financier appreciates the work of SPAK regardless of what opinion or judgment the Albanian political actors have.
The fact that the European Commission in the 2024 report distinguishes the work of SPAK, BKH and GJKKO from other law enforcement institutions for good performance shows support and appreciation for the work done so far. Let's not forget that the EU is the second financier of the justice reform and is audited for the money spent. The evaluation shows that this body is on the right track in their eyes.
The fact that the proposal to extend the mandates of the current prosecutors by changing the Constitution comes as a proposal of the financiers of the justice reform, not of the political parties in Albania who voted for it with 140 votes, is a signal that there is no room for negotiation with local actors but for execution as in 2016. A scenario similar to 2016 is expected to occur in 2025 where, against the will of some deputies, they vote in favor to ensure the quorum of necessary for the suppression of the constitution. This international imposition leaves no room for bargains or negotiations between the leaders of the political forces and Mr. Dumani. So, the internationals want to continue this reform with these current prosecutors regardless of what the local actors think
The fact that 70% of the citizens appreciate the work of SPAK so far shows that the expectations of the public have been fulfilled to some extent. Contrary to the opinion of the DP, the public opinion sees that the fulfillment of expectations for the investigation and punishment of all those who have abused public funds and fulfills only SPAK, KKH and GJKKO.
The fact that the media attention is on the investigation or the fate of the files that are under review by SPAK is a form of pressure on this body to be correct with the law. The increased transparency towards this body thanks to the media is a pressure mechanism from the public as it judges the work of bodies such as SPAK, BKH and GJKKO whether it is on the right track or not. With all the cost of showing popular trials not always good. This method of pressure increases transparency towards the public, but also the pressure that the files under investigation be closed and sent for trial to the GjKKO.
The campaign of the SP and the Prime Minister in particular to treat the justice reform and SPAK as trophies of the political force they lead should be understood not as a reality but as an impossibility to enable such a thing. The two main forces have led justice enough these years, this period is over.
Understand the Prime Minister's message about justice and SPAK in particular, not as a pleasure that no longer controls it, but as a sadness that has lost control over it since the internationals decide that in Albania the third branch of justice should start functioning.
