Why are KLP members clashing?

Members of the KLP, which should have been the High Prosecutorial Council but is nothing more than a council that votes for interests, promotes prosecutors with political support or part of well-known groups, are quarreling among themselves for "banal" reasons.

The insults, the inappropriate vocabulary of Sokol Stojan, who represents one group, and the leader Mirela Bogdani of the other group, have been coming out for a year with labels of thugs and not at all institutional.

The reason?

Just one: Interests.

They gathered to discuss the opening of vacancies for prosecutors in the Appeals Prosecution Office, which according to the judicial map is one and only. The facts show that this prosecution has only 11 prosecutors out of the 20 it should have. But one camp, which also includes Sokol Stojani, aims to hold the vacant positions hostage pending the end of the mandate of the prosecutors who have been appointed as inspectors in the ILD and undoubtedly also to keep vacant positions for the first SPAK prosecutors whose mandates are ending soon.

The other side says that this situation cannot continue indefinitely in waiting, stalling the appeal due to the lack of prosecutors and depriving any other prosecutor who meets the criteria to advance in their career with this "preemption".

In this aggravated climate, members sit down to vote even earlier, whenever there is interest.

The party that is scapegoating Mirela (the chairwoman) are prosecutors who have been in the system and are convinced that the system is them. That is why they are emboldened and believe that they will get some votes from the representatives of the academic world or those members who call them in bullying language "you EU".

It turns out that: Four of the members (including Stojan, Oliger Eminaj of the latest scandal, Erind Germenji and Moisi Duda) vote against opening the vacancies.

The remaining members are divided into two subgroups.

Three vote: to open two vacancies.

But the group that says "no" to opening vacancies considers the decision to be made because they believe they are the majority.

In fact, the law at this point is as clear as 1+1=2.

Law 115/2016 in article 166 point 2 states "The KLP decides by a majority vote of the members present".

Simple calculation: 9 members present, four voted. Five others did not. Five is the majority, so there is no decision.

But Stojan, who is heard in the audio, has a different math, he calculates that the number 4 is the majority and therefore considers the decision made and curses.

The issue of votes has gotten them into trouble before, where the members are just as banal and not at all in the interest of the republic's prosecutors.

Like for example, Transfers!

This tense meeting was related to the fate of four prosecutors who were transferred with consent from the districts to Tirana for a period of 1 year. In the conditions when this deadline has expired and when the law states that the duration of the transfer cannot be more than 1 year, the members sit down to discuss. Despite the fact that the same camp, which also includes the honorable prosecutor Sokol Stojani, had previously voted for the Elbasan prosecutors, saying "no" that they could not continue beyond this deadline, in the case of Tirana, the camp changes its mind.

The Stojani group votes "they can stay on temporary assignment".

The Bogdani Group votes: they cannot meet the deadline and the procedure for transfer with consent should be opened again. The council is divided again with the votes being read incorrectly again and currently, in violation of the law, four prosecutors remain transferred without any decision. The scandal that follows from this decision-making is that in the future, the investigative actions of these 4 prosecutors will be challenged in court for invalidity with claims that they have investigated prosecutors against whom the council has not given a decision on where they have competences.

At the height of preparations to open the race for the leadership of SPAK in September 2025, I reported exclusively how some members attempted to touch on the issue of voting related to the number of votes, which would essentially impact the Special Prosecution Office.

But when it comes to SPAK, the KLP groups are calm and polite in appearance and do not quarrel, because the internationals are watching them and perhaps that is why they are not so brave as to be alone with each other.
