Sali Berisha has been jailed today for a crime stemming from the use of his power to enrich the girl in a corrupt affair, but it will be unfair for him to go to the next world with this sentence, which resembles the trial for the coffees of Nexhmije Hoxha before the real real crime that he has committed in Albanian politics, which is the killing of citizens for political motives. 

The decision of the Supreme Court of Albania, that the January 21 case be investigated by SPAK, restores the chance for Albanian justice to investigate the most serious state crime of 33 years, when the country's prime minister, knowingly involved in political murders against citizens, was involved in conscious efforts to hide evidence and pressure on Albanian justice not to investigate and judge, using political power.

The decision, which comes after the decision of the Strasbourg Court, which calls the murder a state crime and its non-trial is a consequence of political pressure on justice, restores the lost chance for Albanian justice to establish its dignity trampled by the power, before a serious and tragic event like that.

There are three clear moments that make Sali Berisha responsible and guilty in this story. 

The first is his attempt at 7:30 p.m. on January 21, 2011, when he came out and said that the protesters were killed by opposition people, through their disguised weapons in the protest, where he also mentioned umbrellas, pistols, knives with poison snakes and other nonsense. To his aid came two politicized doctors who preceded the statements that the victims had been shot at close range with light rifles, which the Garda does not have, and then TV Klan which illustrated it with the image of a frightened old man with an umbrella who was near the late Ziver Veiz.

After midnight, when it became clear on video that the murders were committed from the Prime Minister's building, Sali Berisha changed his version, justified the murders as an attempt to stop a coup d'état and indicted the country's president, the country's chief prosecutor and four journalists.

All this effort of his first to hide the authorship of the crime and then to justify it, is a conscious effort to justify the state crime.

Secondly, Sali Berisha was involved in tampering with evidence and non-cooperation with justice.

He initially stated that the Prime Minister's camera server would be available to the investigation, but he physically removed it, according to FBI expertise, at 1:30 a.m. on January 22, midnight, replacing it with a new computer. 

He refused to hand over the six guardsmen suspected of the murders, on the grounds that it affected, according to him, the "chain of command" of the Guard, in the invented conditions of the "Coup d'état", and did not allow the two prosecutors willing to document the crime scene in front of the Prime Minister , cleaning the cartridges in their eyes and changing the door of the Prime Minister's Office.

Later, the investigations proved that the Guard changed the barrel of the pistol with which Alex Nika was killed, and the documents of the storage of weapons in the Guard were tampered with.

All of them are acts with consequences, destruction of evidence, and the responsibility for them was taken publicly at that time and later by Sali Berisha himself.

Third, Berisha took public political action to pressure the judiciary not to investigate, setting up an investigative commission against the president, chief prosecutor and journalists accused of coup d'état, putting them on political charges and filling the courtroom with guards, while two of those accused of murder were tried, Guard commander Ndue Prendi and guard Agim Llupo, who were released with ridiculous sentences.

Even today, the author of Alex Nika's murder has not been proven due to the destruction of the evidence, and the completion of the lead expertise in Italy is awaited.

The full investigation and trial of this event increases the weight of the new justice, as it brings to another level the restoration of justice in the country, punishing Albanian politics for one of the ugliest things in the history of 33 years of democracy, which is murder for political reasons and four innocent, unarmed, helpless and harmless citizens who exercised their right to protest in front of the Prime Minister's Office.

On January 21, Sali Berisha proved his rejection of the democratic order as a politician, his rejection of protest and opposition as a concept, and above all, his rejection of trial as a criminal when he was caught with facts in the middle of the day. 

For all these reasons and others, he and his family have been declared "non grata" by the USA and Great Britain, but Albanian justice is still reluctant to say its word.

Today, a small step has been taken in restoring this chance. Until the day that justice pronounces his punishment as guilty of this crime, we still cannot say that the new justice has returned to Albania.

January 21 is not a punishment for Sali Berisha, but a test to touch and feel that the new justice has arrived.
