The Court of Fier has sentenced to prison a pimp, who used a citizen for prostitution in the premises of her rented premises located in the "Apollonia" neighborhood.
It is reported that the tutor with the initials Y.XH practiced this activity with the customers of the bar against the amount of 3000 to 5000 ALL.
She was found guilty of 'Exploiting Prostitution' and 'Keeping Premises for Prostitution', and was sentenced by the black gangs to 4 years in prison, but benefited from a summary trial and was sentenced to 3.4 years in prison.
While the citizen with the initials HO, was sentenced to 1 year in prison for committing the criminal offense "Prostitution", but the conclusion of the trial was shortened and the sentence was reduced to 8 months.
The court decided to suspend the execution of the prison sentence for the unserved part of the sentence for the defendant HO by putting her on probation for 16 months on the condition that during the probationary period she does not commit another criminal offense and maintains contact with the Office of the Service of Test, Fier Territorial Branch.
"The Prosecutor's Office at the Court of First Instance of Fier General Jurisdiction completed the investigations and sent the citizens Y.Xh. and HO for the criminal offenses 'Exploiting prostitution' and 'Maintaining premises for prostitution' provided by article 114/1 and 115 of the Criminal Code.
As part of the investigations carried out using proactive methods on criminal proceedings no. 294, registered on the basis of the incriminating material sent by the Fier Local Police Directorate, on 30.11.2022, it was found that the citizen Y.XH, in the premises of her bar rented property located in the "Apollonia" neighborhood, Fier used the citizen HO for prostitution, where the latter practiced this activity with the customers of the bar against the amount of 3,000-5,000 ALL.
With decision no. 62-2024-41-58 (606) dated 29.07.2024, the Court of First Instance of General Jurisdiction Fier decided:
The guilty plea of the defendant Y. Xh for committing the criminal offense "Exploitation of prostitution" and, based on Article 114/1 of the Criminal Code, her sentence of 4 years imprisonment.
The guilty plea of the defendant Y. Xh for committing the criminal offense of "Owning premises for prostitution" and, based on Article 115 of the Criminal Code, her sentence of 2 years imprisonment.
On the basis of Article 55 of the Penal Code, the defendant Y. Xh is sentenced to 5 years of imprisonment, in the consolidation of the sentences.
In the application of Article 406/1 of the Criminal Code of the defendant Y.XH, 1/3 of the punishment is reduced and she is finally sentenced to 3 years and 4 months of imprisonment. The serving of the sentence starts from the date of arrest.
The guilty declaration of the defendant HO for committing the criminal offense "Prostitution" and based on Article 113/1 of the Criminal Code, her sentence of 1 year imprisonment.
In the application of Article 406/1 of the Criminal Code of the defendant HO, 1/3 of the punishment is reduced and she is finally sentenced to 8 months of imprisonment.
Based on Article 59 of the Penal Code, suspend the execution of the prison sentence for the unserved part of the sentence for the defendant HO by putting her on probation for 16 months, provided that during the probation period she does not commit another criminal offense and to maintain contact with the Probation Service Office, Fier Territorial Branch.
