The defendant was found guilty of rape, grievous bodily harm and threats against his wife and in the presence of minors. The court ruled that his appeal would not have a suspensive effect on the execution of the sentence, and so he was sent to prison.

According to her statement to the police, which was read out in court after she failed to appear to testify, the 40-year-old physically abused her, even in the presence of their children, and raped her. In fact, after sexually abusing her, the victim complained that the defendant urinated on her.
The victim also reported that the 40-year-old was constantly walking around their house drunk and naked.
It is noted that the 40-year-old, of Albanian origin, was released on bail after his arrest and was tried in absentia, after failing to appear in court.
