The Special Court against Organized Crime and Corruption has requested the termination of the sterilization concession worth 100 million euros before the end date.
This is due to the problems and violations identified by SPAK, where the former Deputy Minister of Health Klodian Rjepaj and the main owner of the company "Sani Service" Ilir Rrapaj, which won the tender of 100 million euros, were arrested.
In addition to the appointment of prison measures for the former deputy minister and the businessman, as well as house arrest and mandatory appearance measures for the former officials of the Ministry of Health and members of the commission, in point 20 of the decision signed by judge Erion Bani, in on June 26, 2023, 11:30 a.m., it is determined that a copy will be sent to the High Inspectorate of Property Declaration and Control.
Specifically, the court asks the ILDKP "to take measures to follow the legal path to establish the invalidity of the concession contract dated December 2, 2015 concluded between the Ministry of Health, represented by the Minister Mr. Ilir Beqaj and the company "SaniService" sh.pk represented by administrator Admir Daca. The latter is the administrator of the company that won the concession, which is a merger of companies, specifically: "Investital LLC", owned by Ilir Rrapaj, owns 40 percent of the shares, SERVIZI ITALIA SPA, 30%, Tecnosanimed 15% and U .JET 15%.
After the investigations started on January 1, 2020, SPAK claims to have found elements of the criminal offenses of "abuse of duty" and "forgery of documents" by officials, including former deputy minister Klodian Rjepaj, Saimir Kadiu, economic director and director Marsela Serjanaj legal in the Ministry of Health.
The same accusations have been raised by SPAK for doctor Arben Gjata, chief of surgery and rector of the University of Medicine, commission members, Naile Ajazi, Genc Byrazeri and Petro Mersini, former general director of the hospital service at the Ministry of Health.
For all these officials, the court states in its decision that a financial investigation should be conducted to see if they have benefited from the criminal offenses they have committed.
The businessman Ilir Rrapaj is accused by SPAK of fraud after he filled out the conflict of interest form with false data, noting that he had no acquaintance or friendship with any of the decision-making officials at a time when he turned out to be a fellow faculty member with Deputy Minister Klodian Rrjepaj, which was the cause for the exclusion of his company from the concession.
We recall that former minister Ilir Beqaj reacted for the first time after the arrests by SPAK for the sterilization concession.
GJKKO directed the Special Prosecutor's Office to extend the investigations to the responsibilities of 6 other persons; for former Minister of Health Ilir Beqaj, former Minister of Finance Shkëlqim Cani, as well as for four procurement commissioners.
Regarding this, Beqaj made a complaint and said that he found out about it from the media.

Oficerët e policisë gjyqësore kanë kërkuar nga institucioni dokumentet origjinale por në datën 20 dhjetor në procesverbal ata kanë dekalruar se megjithë kërkimet në arkivë nuk u gjet dokumenti origjinal, madje as anekset përkatëse.
