GJKKO has sentenced a total of 5 of the accused for the murder of Behar Sofia to 127 years in prison. Ernejt Shyti, who shot Sofia to death and cooperated with the prosecution to clarify the incident, was sentenced to 7 years of imprisonment.

While the other 4 people, Skënder Vathi, Bujar Leza, Leonard Xhixha and Xuljano Visha, were sentenced to 30 years in prison, which they will serve in a high security prison.

As for the process, Jemin Sherres, who is suspected of ordering the murder of Sofia, has been singled out because he is still wanted. We remind you that the process in absentia against Jemin Shera started in January of this year.

We remind you that on the morning of February 25 (2021), Behar Sofia, known as the "drug lord", was followed by the executioner Ernejt Shyti, who a few meters from his house, appeared in front of the 66-year-old and shot him near the Pyramid in capital city. Dressed in sportswear, with a hat, glasses and an anti-Covid mask, after committing the assassination, the perpetrator left and crossed the Lana bridge on foot.

He then took a bicycle near the towers and left for the Lake Hills. Shyti was arrested in Montenegro, while in the testimony given in the Court, he showed in detail the role of the other defendants.

Announcement of GJKKO:

1. The Special Prosecutor's Office against Corruption and Organized Crime submitted to the Court the request with the object: Sending for trial the criminal case against the defendants Ernejt Shyti, Xhuljano Visha, Bujar Leza, Leonard Xhixha and Skënder Vathi.

2. The trial of this case took place with the rules of ordinary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judges Atalanta Zeqiraj, Erjon Bani and Flora Hajredinaj, with decision No. 5 dated 24.01.2024 decided:

1. The guilty plea of ​​the defendant Ernejt Shyti for committing the criminal offense "Premeditated murder", in cooperation in the form of a structured criminal group, provided by articles 78/2, in relation to articles 28/4 and 334 point 1 of the Code Criminal and sentenced to 30 (thirty) years of imprisonment.

2. The guilty plea of ​​the defendant Ernejt Shyti for committing the criminal offense "Unauthorized possession and production of weapons, explosive weapons and ammunition", in cooperation in the form of a structured criminal group, provided by articles 278/1, in relation to articles 28/4 and 334 point 1 of the Criminal Code and his sentence of 10 (ten) years of imprisonment.

3. The guilty declaration of the defendant Ernejt Shyti for the criminal offense "Structured criminal group", provided by article 333/a/2 of the Criminal Code and his sentence of 2 (two) years of imprisonment.

4. Based on Article 55 of the Penal Code, the defendant Ernejt Shyti is sentenced to a single sentence of 30 (thirty) years of imprisonment.

5. Based on Article 28 point 7 of the Criminal Code, the defendant Ernejt Shyti, in the capacity of an associate of justice, has his sentence reduced and finally sentenced to 7 (seven) years of imprisonment.

6. The serving of the sentence for the unserved part shall be carried out by the defendant Ernejt Shyti in a high security prison, in compliance with Article 16 point 1, letter "a" of Law No. 81/2020 "FOR THE RIGHTS AND TREATMENT OF IMPRISONMENT CONVICTS AND PRISONERS".

7. The guilty plea of ​​the defendant Xhuljano Visha for committing the criminal offense "Premeditated murder", in cooperation in the form of a structured criminal group, provided by articles 78/2, in relation to articles 28 point 4 as well as 334 point 1 of Penal Code and his sentence of 30 (thirty) years of imprisonment.

8. The guilty plea of ​​the defendant Xhuljano Visha for committing the criminal offense "Possessing and manufacturing weapons, explosive weapons and ammunition", in cooperation in the form of a structured criminal group, provided for by articles 278/1, in relation to articles 28/4 and 334 point 1 of the Criminal Code and his sentence of 10 (ten) years of imprisonment.

9. The guilty declaration of the defendant Xhuljano Visha for the criminal offense "Structured criminal group", provided by article 333/a/2 of the Criminal Code and his sentence of 2 (two) years of imprisonment.

10. Based on Article 55 of the Penal Code, the defendant Xhuljano Visha is sentenced to a single sentence of 30 (thirty) years of imprisonment.

11. The serving of the sentence for the unserved part shall be carried out by the defendant Xuljano Visha in a high security prison, in compliance with Article 16 point 1, letter "a" of Law No. 81/2020 "FOR THE RIGHTS AND TREATMENT OF IMPRISONMENT CONVICTS AND PRISONERS".

12. The guilty plea of ​​the defendant Bujar Leza for committing the criminal offense "Premeditated murder", in cooperation in the form of a structured criminal group, provided by articles 78/2, in relation to articles 28/4 and 334 point 1 of the Code Criminal and sentenced to 30 (thirty) years of imprisonment.

13. The guilty declaration of the defendant Bujar Hasan Leza for committing the criminal offense "Possessing without permission and the production of weapons, explosive weapons and ammunition", in cooperation in the form of a structured criminal group, provided by articles 278/1, in connection with articles 28 points 4 and 6, as well as 334 point 1 of the Criminal Code and his sentence of 10 (ten) years of imprisonment.

14. The guilty declaration of the defendant Bujar Leza for the criminal offense "Structured criminal group", provided by article 333/a/2 of the Criminal Code and his sentence of 2 (two) years of imprisonment.

15. Based on Article 55 of the Penal Code, the defendant Bujar Leza is sentenced to a single sentence of 30 (thirty) years of imprisonment.

16. Vuajtja e dënimit për pjesën e pavuajtur të kryhet nga i pandehuri Bujar Leza në një burg të sigurisë së lartë, në respektim të nenit 16 pika 1, gërma “a” të Ligjit Nr. 81/2020 “PËR TË DREJTAT DHE TRAJTIMIN E TË DËNUARVE ME BURGIM DHE TË PARABURGOSURVE”.

17. Deklarimin fajtor të të pandehurit Leonard Xhixha për kryerjen e veprës penale “Vrasje me paramendim”, në bashkëpunim në formën e grupit të strukturuar kriminal, parashikuar nga nenet 78/2, në lidhje me nenet 28/4 dhe 334 pika 1 të Kodit Penal e dënimin e tij me 30 (tridhjetë) vjet burgim.

18. Deklarimin fajtor të të pandehurit Leonard Xhixha për kryerjen e veprës penale “Mbajtja pa leje dhe prodhimi i armëve, armëve shpërthyese dhe i municionit”, në bashkëpunim në formën e grupit të strukturuar kriminal, parashikuar nga nenet 278/1, në lidhje me nenet 28 pika 4 dhe 6, si dhe 334 pika 1 të Kodit Penal e dënimin e tij me 10 (dhjetë) vjet burgim.

19. Deklarimin fajtor të të pandehurit Leonard Xhixha për vepër penale “Grupi i strukturuar kriminal”, parashikuar nga neni 333/a/2 i Kodit Penal dhe dënimin e tij me 2 (dy) vjet burgim.

20. Bazuar në nenin 55 të Kodit Penal në bashkim të dënimeve i pandehuri Leonard Xhixha dënohet me një dënim të vetëm prej 30 (tridhjetë) vjet burgim.

21. Vuajtja e dënimit për pjesën e pavuajtur të kryhet nga i pandehuri Leonard Xhixha në një burg të sigurisë së lartë, në respektim të nenit 16 pika 1, gërma “a” të Ligjit Nr. 81/2020 “PËR TË DREJTAT DHE TRAJTIMIN E TË DËNUARVE ME BURGIM DHE TË PARABURGOSURVE”.

22. Deklarimin fajtor të të pandehurit Skënder Vathi për kryerjen e veprës penale “Vrasje me paramendim”, në bashkëpunim në formën e grupit të strukturuar kriminal, parashikuar nga nenet 78/2, në lidhje me nenet 28 pika 4 dhe 6, si dhe 334 pika 1 të Kodit Penal e dënimin e tij me 30 (tridhjetë) vjet burgim.

23. Deklarimin fajtor të të pandehurit Skënder Vathi për kryerjen e veprës penale “Mbajtja pa leje dhe prodhimi i armëve, armëve shpërthyese dhe i municionit”, në bashkëpunim në formën e grupit të strukturuar kriminal, parashikuar nga nenet 278/1, në lidhje me nenet 28 pika 4 dhe 6, si dhe 334 pika 1 të Kodit Penal e dënimin e tij me 10 (dhjetë) vjet burgim.

24. Deklarimin fajtor të të pandehurit Skënder Vathi për vepër penale “Grupi i strukturuar kriminal”, parashikuar nga neni 333/a/2 i Kodit Penal dhe dënimin e tij me 2 (dy) vjet burgim.

25. Bazuar në nenin 55 të Kodit Penal në bashkim të dënimeve i pandehuri Skënder Vathi dënohet me një dënim të vetëm prej 30 (tridhjetë) vjet burgim.

26. Vuajtja e dënimit për pjesën e pavuajtur të kryhet nga i pandehuri Skënder Vathi në një burg të sigurisë së lartë, në respektim të nenit 16 pika 1, gërma “a” të Ligjit Nr. 81/2020 “PËR TË DREJTAT DHE TRAJTIMIN E TË DËNUARVE ME BURGIM DHE TË PARABURGOSURVE”.

27. Bazuar në nenin 190 të K.Pr.Penale lidhur me provat materiale të sekuestruara në kuadër të këtij procedimit të mbetet pjesë e fashikullit në kuadër të procedimit penal të ndarë në ngarkim të të pandehurit Jemin Shera.
