The Supreme Court has overturned the decision of the Elbasan Court of November 2019, a decision that was also upheld by the Durrës Appeal for the release of Florenc Çapjas.
Çapja is wanted internationally, as SPAK demands his sentence of 25 years in prison for the murder of father and son, Nezir and Gentian Beqiri in 2012.
After the case against him was dismissed in 2019, Çapja was released from prison and is no longer in Albania. He is believed to be hiding in Dubai, a haven for criminals and very difficult to get extradition deals from.
The trial panel composed of Ilir Panda, Sokol Binaj and Sandër Simoni examined the prosecutor's appeal, which opposed the dismissal of the case for the attempted murder of Fadil Mema, the former traffic officer.
On November 20, 2019, judge Tomor Kullolli decided to suspend the case for Florenc Çapjan, releasing the latter from the cell.
At that time, the court stated that there is not enough evidence to implicate Çapjan in this event. The decision to dismiss was taken at the preliminary hearing, where the court had to decide whether or not to proceed with the file for trial.
The decision taken by the Elbasan court was also upheld by the Durrës Appeal, specifically by judge Anita Mici on April 14, 2020.

Who is Florenc Çapja and why was he arrested?
Florenc Çapja, the well-known member of the tribe, Çapja, was arrested on June 14, 2019 during a "KRASTA" operation in Elbasan after he was charged with "Attempted premeditated murder" and "Unauthorized possession of weapons and ammunition". .
Çapja was charged with a crime committed in 2006 in Elbasan, where former police officer Fadil Mema was killed. For this crime, he was arrested two more times but was released due to the lack of evidence and witnesses. After Kullori's decision, Çapja was released again to be arrested in June.
The desire to physically eliminate Fadil Mema came after Sokol Çapja was killed in Elbasan in December 2005. This also started the saga of consecutive murders. Sokoli and Dritan Sheme, a contract killer and friend of Fadil's wife, is ordered by Çapja to kill Rezart Çela in Elbasan. The death contract was agreed between Sheme and Sokol Çapjas for 30,000 euros. The plan was carried out, Sheme, as a professional killer, executes Rezart Çela in October 2005, and after a few days appears to Sokol Çapja, to ask for the difference of 15 thousand euros. There was a collision here. Between the paid killer Sheme and Sokol Çapja, a new conflict opens, where there were several attempted murders by both sides after the fight over the money.
Fadil Mema, former Elbasan traffic police officer, who after a few days had gone to Çapjave bar "Univers" spontaneously entered this conflict to celebrate his 50th birthday. Here Mema clashed with Çapaj, as the latter asked him that Dritan Sheme, who was included in his guest list, should not be in that bar. After this event, three people killed Sokol Çepjan in 2005 in a bar in the city. The Çapja tribe was very angry and wanted revenge. In that period, the police declared Dritan Shemen wanted, meanwhile arrested his two associates Gentian Beqiri and Armando Hasan.
Meanwhile, the head of the Çapja tribe was added and they demanded retribution from Fadil Mema, to whom they later apologized after being hit with 11 bullets. But even though he left Albania for Italy, Fadil Mema could not walk, he was executed.
The history of enmity with the Mema tribe
The story started in 2005, where Sokol Çapja was involved in a conflict with the former head of Road Traffic in Elbasan, Fadil Mema.
Sokol Çapja was killed after this event, while the nephews of the Police officer were accused as perpetrators, but it did not end there, as the Çapjas took revenge by killing Fadil Mema's brother-in-law, Ardian Ibrahimi in May 2006.
In 2012, Gentian Beqiri, one of the accused for the murder of Sokol Çapjas, was executed, while in March 2015, Fadil Mema was also executed in Turin, Italy.
On February 3, 2016 - the first assassination attempt on the Çapja family took place, where Agron Çapja, his nephew Ardit Sinakoli and Eno Bedalli were killed, while Florenc Çapja was among the eight wounded.
On August 6, 2017 - Ardian Çapja was assassinated for the second time, he was hit by a shell, but luckily for him the shell did not explode, causing Ardian Çapja to let him go in peace.
The third assassination took place again in 2017, where he was hit with a Kalashnikov and other weapons near his apartment, but as soon as he heard the shots, he went inside, escaping the bullets.
The car used by the perpetrators, who have not been found even today, was stolen and belonged to a businessman in Tirana, Xh. Hoxha. After the assassination, the perpetrators burned the car and with it the evidence that the police could find.
On June 8, 2020 - the fourth assassination against him and his family took place, where Ardian Çapja was hit by a sniper from a hill. The 53-year-old was taken to the Trauma hospital in serious condition.
