The Special Court has rejected SPAK's request to change the security measure for border guard Jonida Babameto, who was found to be collaborating with the group of Ervin Mata and the son of Erzen Breçani.
An "obligation to appear" was imposed on her, but SPAK requested a measure of arrest and imprisonment. However, GJKKO did not accept and left the previous measure in force.
Court notice
1. The Special Prosecutor's Office against Corruption and Organized Crime, on 24.11.2023, addressed the Court with the request with the object: Assigning to the person under investigation JB the personal security measure "Arrest in prison", provided by article 238 of K. Pr. Penal.
2. Regarding the examination of this request, the Court decided to examine it in the consultation room without the presence of the parties and the court secretary. The Special Court of First Instance for Corruption and Organized Crime with a panel composed of judge Elsa Ulliri, based on articles 228, 229, 230, 238, 248, 379 and 384 of the Criminal Code, with decision No. 130, dated 24.11.2023, decided, among other things:
Acceptance of the request.
Verification of the conditions of implementation of the coercive personal security measure "Prohibition of exiting the country" and "Compulsion to appear before the judicial police", provided by article 233 and 234 of the Penal Code given to the person under JB investigation with decision No. 124, dated 17.11.2023 of the Special Court of First Instance for Corruption and Organized Crime and the continuation of the implementation of these measures.
The person under investigation JB is ordered not to leave the territory of the Republic of Albania without the authorization of the court.
It is forbidden to use the passport and other valid identification documents for exiting the country for the person under investigation JB
The person under investigation JB is ordered to appear at the judicial police at the prosecutor's office, on the last Thursday of every month, at 13.00.
The Special Prosecutor's Office against Corruption and Organized Crime and the Judicial Police are ordered to follow up and implement this decision.
An appeal against this decision is allowed in the Special Court of Appeal for Corruption and Organized Crime within 5 days, starting from the day after the communication of the decision.
