The Ivrea Prosecutor's Office in Turin has requested a life sentence for Davide Osella Ghena, the perpetrator of the murder of Albanian Fatmir Ara.
Porcuoria has requested 22 years in prison for his sister Barbara Osella and 13 years for their friend who collaborated in the crime, Andrea Fagnoni.
A hearing will be held on January 22nd for the defense's conclusions for the accused.
Barbara and Andrea have chosen not to give statements throughout the investigation and trial. The Italian investigating body concluded that the crime was committed so that the perpetrator would not look bad to his fiancée and mother-in-law, for a sum of 80 thousand euros.
43-year-old businessman Fatmir Ara was contacted to carry out some work on a facility that would serve as a tourist attraction for the author's wife's family. The prosecution claimed that Davide ran out of money and at this point has begun to blame the Albanian, whom he invites to meet in a mountainous area with the claim that he would carry out some work, but when the father of four children arrived, he was confronted with gunfire that took his life.
The sister provided the couple with permission to pick her up from her father's apartment, while their friend drove away from the scene.
Ara left four orphaned children, aged 5 to 18, and his family insisted until the end for justice.
"I didn't kill him. I had people tell me why I gave the job to Fatmir and not us," Davide would claim, but according to the Prosecution, the defendant cannot prove these statements.
Mirela, Fatmir's sister, and her husband Walter attended every court session, while on Tuesday, January 14, after the prosecution's request, they are demanding that this process be reflected, to finally clear the image of their family member, who would be reported in 2022 even if he was part of criminal groups or that the incident was a result of the Albanian's criminal precedents.
An answer to this option is given by the representative of the Italian Prosecutor's Office and the victim's lawyer during the trial of this case.
The prosecutor spoke with determination in court, reiterating that the meticulous planning of Fatmir Ara's murder, carried out in collaboration, deserves a harsh response, a sentence that signals the gravity of the gesture and the dangerousness of the accused.
The victim's lawyer, Celere Spaziante, refuted the previously stereotyped image that considered the deceased a "bandit." Spaziante said she sought to restore dignity to Fatmir Ara, "a man who, despite his controversial past, did not deserve to be sacrificed like this."
"Fatmir Ara was not the criminal they described," the lawyer continues in court. "He was a man who worked hard, every morning, to guarantee a better future for his family. He was a father who loved his children, so much so that he tattooed their names on his skin, a man who loved Italy to the point where he named one of the girls 'Fiorentina', whom he left at the age of 5, in honor of this country that had given him so much. He was a man of great dignity, who had built with difficulty, a solid, respected company in the Canavese area, a man who was undergoing an ordinary trial, but who should not have died that way. We had to endure, listening to the lies of those who tried to build a confession that did not correspond to the truth. 17 hours of interrogation and the prosecutor wasted time listening to contradictory versions. How much time was wasted? How much pain was caused to a family that had already lost everything?", said the lawyer.
The lawyer also presented a strong argument at the trial related to the manner in which the young man from Shkodër was executed.
"Davide Osella Ghena dragged him through the branches, threw him like a bag of garbage. A man who gave so much, who worked and contributed to the community, was treated like trash, like an object. How can all this be justified? Osella Ghena is a dangerous man, who lied throughout the trial. He was not a man who could be judged as the "sick" that the defense tried to portray. He was a man who had a specific goal: to kill Ara, there is no room for mercy," she said.
Family members who attended the trial said that today was not just about a crime.
"We talked about dignity, humanity and justice, topics which, as never before, took precedence over any other consideration."
The businessman's lifeless body was found on the ground, next to his car, on the edge of a narrow road not far from the company he owned in September 2022, and it was reported at the time that the body had been mistreated. The 43-year-old had been missing since September 2 of the same year.
Fatmir Ara was arrested by the Turin Police in 2018 because his ex-wife had reported him for domestic violence. The trial showed, according to the legal representatives of the victim's family, that Ara's murder was not related to this precedent, but to the circumstances on which the prosecution's claim was presented.
