The Code of Criminal Procedure in article 164 specifies how to act when a witness avoids the summons of the court.
The Berisha family seems to be in trouble with justice. The former prime minister tried several times to avoid SPAK, but in the end it seems that he did not calculate well, as he risks ending up in "house arrest". His son-in-law is also under "house arrest" and SPAK has appealed the decision for him, asking the Supreme Court for arrest.
But it seems that Shkëlzen Berisha is also in trouble now, who today tried to follow his father's path to escape justice. Shkëlzeni was called to testify in Fatmir Mediu's trial for Gërdec, but he acted like Berisha, refusing to accept the request and today the court was told that his address could not be found. This method was also followed by Berisha, but he did not succeed. But in this case, Shkëlzeni was called as a witness and not as a defendant.
The Code of Criminal Procedure in article 164 specifies how to act when a witness avoids the summons of the court. He can be fined and if he refuses, then he can be escorted by force. Now GJKKO is in the test. It remains to be seen if he will ask the police to find the son of the former prime minister and go to court, or if he will act the same as with his father.
" When the witness, summoned regularly, does not appear at the appointed place, day and time, without legal obstacles, the court may order compulsory escort or impose a fine of up to ALL 30,000 ", states Article 164.
Like Berisha, Shkëlzeni also stated in a reaction that there was no invitation to appear as a witness either at his physical or electronic address. While he says that he is ready to appear according to the law upon receiving the invitation
" Regarding some media reports about my "non-appearance" as a witness in court, I have to clarify that no invitation to appear to testify has arrived at any of my physical or electronic addresses! SPAK's claims, which are clearly a function of Edi Rama's political and media goals, fall apart, both from the previous notifications that were successfully executed, and from the fact that I personally filed the CORRECT address as and phone number! I remain open to appear in accordance with the law upon receiving the invitation ," he said.
