Berisha defends Meta, attacks Irena Gjoka: Delinquent, keeps Ilir's file

Former Prime Minister Sali Berisha, also the leader of the DP, appeared today at SPAK in compliance with the security measure "compulsory appearance" in the framework of the process for the 'Partizani' file. Berisha has continued the ritual of attacks and accusations against specific names of SPAK and GJKKO, where as always the target of the former Prime Minister are Altin Dumani and Irena Gjoka.

Regarding the GJKKO judge, Berisha said that Gjoka hid her conviction and deportation from Greece for falsifying documents and under such conditions she should have left the system.

Labeling her as a delinquent and with five adjectives, the DP leader said that they have turned to the Supreme Court of Justice to review her mandate, because according to him, there is a final decision against her in the neighboring state.

"Gjoka should have been dismissed with the entry into force of the decriminalization law because he concealed his conviction and deportation from the neighboring country. He is being defended by the head of SPAK, Altin Dumani, the General Prosecutor's Office and the Supreme Court of Kosovo," Berisha said.

Gjoka, according to the democratic leader, is being used as a "blind spot" for processes against the opposition.

"First, it illegally delays the decision-making on the determination of the end of the mandate since Irena Gjoka could not be a judge when the law prevented a person with a criminal conviction from holding such a function. Secondly, the Supreme Court of Justice, Uluzi Fajja e Zezë, Altin Troplini and other puppets of the government, intentionally dragged out the investigation into the issue of violation of the decriminalization law by Irena Gjoka, who has hidden and has not declared in the form either the criminal conviction or the two expulsions from Greece with the clear intention of exceeding the deadlines for criminal prosecution, i.e. the statute of limitations for the criminal offense," said Berisha.

For Berisha, Gjoka should have been in prison for failing to declare in the decriminalization law.

"The first is the criminal prosecution against Irena Gjoka. The failure to declare on the decriminalization form is a criminal offense for which she should have been in prison. The second, the failure to declare the criminal decision on the decriminalization form again brings about the termination of the mandate from the moment the violation was committed. This is an administrative procedure, therefore not criminal, for which no statute of limitations of the criminal code applies. There is no need for such a complex verification action," he added.

Following the accusations, Berisha said that "Irena Gjoka did not have the criteria to be a judge, this makes any judicial procedure conducted by her, after the election of a judge, in violation of the law, a procedure conducted by a court not designated by law."

In this context, the democratic leader stated that every decision by Irena Gjoka, since the day she cheated on the decriminalization forms, is invalid, null and void because it was made by a person who could not be a judge.

"This, according to the Constitution, but also according to the European Court of Human Rights. According to the precedent of the European Court of Human Rights, Cani v. Albania, Irena Gjoka cannot be a judge and the processes followed by her are null. I recall here that she is kept in office because she holds the file of Ilir Meta, a file that does not contain any criminal facts, except for the primitive vengeful decision of Edi Rama against him," said Berisha.
