Their early acquaintance from the time they worked at the Supreme Court helped Ms. Bashari bypass the legal criterion of 15 years of seniority as a lawyer, provided for by article 12, letter “b” of law no. 9049, dated 10.4.2003, to be elected director of the HIDAKKI. This criterion was used by the Assembly in 2014 to dismiss Zana Zhuka, precisely for lack of seniority in the profession.
The friendship between them did not prevent Ms. Bushka from participating in the selection process of Ms. Bashari's candidacy for Inspector General of the HIDACCI. According to official data from the Assembly, Ms. Bushka, at that time a deputy, was a rapporteur in the Legal Affairs Committee, i.e. the person responsible for controlling and verifying the documentation submitted by Ms. Bashari for fulfilling the legal requirements.
Also, according to the published biography, Bashari did not declare during her candidacy for the position of chairwoman of the HIDAKKI the period of her employment at the Audiovisual Media Authority (AMA). In addition, she also concealed the fact that during this period, the Supreme State Audit Office (SSA) found violations in the duties of the Director of the Legal and Licensing Department of the AMA, according to the SSA report for 2017.
According to this report (decision no. 153, dated 31.10.2017, p. 13), AMA was also recommended to be removed from office, and a referral was made to the Prosecutor's Office for the violations found.
So, Ms. Bashari, currently the chairwoman of the HIDAKKI and a friend of the former chairwoman of the Laws Commission, has kept these facts secret during the process of her selection to head a constitutional institution that has a key role in justice reform and the fight against corruption.
The questions that arise:
How was Bashari accepted to work at AMA and how did he later return to HIDAKKI?
What measures did AMA take to implement the recommendations of the SAI?
Why did the Assembly not properly verify the non-fulfillment of seniority in work and the non-declaration of the violations found?
The non-declaration of these facts, together with the non-fulfillment of seniority criteria, have directly affected a constitutional process such as the selection of the president of HIDAKKI by the Assembly of Albania./ Pamphlet
