The well-known lawyer, Kreshnik Spahiu commented on the security measure requested by the Special Prosecutor's Office (SPAK) for the former Prime Minister Sali Berisha and the process initiated against him for passive corruption regarding the privatization of the former "Partizani" complex. During an interview for "SOT" newspaper, the lawyer Spahiu told what will happen tomorrow with Sali Berisha, as he added that if he will be in the courtroom, he will be taken by the police by car and escorted to his apartment. Also, the lawyer Spahiu revealed the reasons why Berisha is being abandoned by former president Ilir Meta and all the allied parties, while he emphasized that after the house arrest the former prime minister's mandate is revoked and according to him, the former prime minister's trial lasts until 2026 Meanwhile, Spahiu added that Sali Berisha is currently abandoned by everyone, even his supporters, which was best seen in the protest called by him last week where no more than 100 people had gathered.

-Mr. Spahiu, do you think the time frame of the procedures that have been left for the arrest of Sali Berisha is expected?

Yes, there are procedures defined in the law, the court needs 5 days to make a decision. Within 24 hours, the Special Prosecutor's Office sent the request and had it ready because it is the same as the one presented to the Assembly. I have stated that the prosecution will request house arrest and the reasons why it requested two measures is to prevent a disrespect on the part of Berisha. If the court imposes house arrest and Sali Berisha opposes it, then SPAK does not have to create a parliamentary procedure and then has the right to aggravate his position from house arrest to prison arrest. Berisha has stated that he does not recognize the authority of the prosecution and the court, and two measures have been requested for this.

- How did you see Berisha's statements after the removal of his immunity was voted in the Parliament?

Every citizen has the right to be protected by law. The question that arises is whether Sali Berisha is seeking to be considered equal before the law or unequal. If an ordinary citizen did not respect the court's decision to appear twice a month, then the court would allow it? There was no such case. Berisha has been treated in a privileged manner, respecting his age and political background.

- With all the decisions that are made about Berisha, how do you see the comments he made about SPAK?

He made such statements for all institutions. And when the Constitutional Court decided against Edi Rama for the arrival of African immigrants, it was a branch of Sali Berisha, because that's how it fits with this logic. Where his interest is affected then it is gang. Why did Rama free his son-in-law? Those judges are not Chinese, they came from the people's bosom, they also came from the opposition's bosom, and they also received the consensus of the democrats. It is unfair to gather 9 analysts and underestimate the judges.

- Does Berisha have the support of Gazment Bardhi and Ilir Meta?

I have followed Sali Berisha and that party since I was little. None of the founders of the Democratic Party were there, there were no citizens, owners, ex-persecuted people, ex-ministers, there was no one, not even their family members, as if 10 family members were brought out by every deputy. Even at a funeral in a village when the chief dies, not so few people gather. Berisha has never been more lonely, a man who was voted by 1 million people to come to power and from 1 million he was reduced to 120, not even the fishermen's association gathers so few people. It is sad to watch the end and collapse of the main political force that was the Democratic Party and this is abandonment for an individual, that the opposition people are bigger than you think. The punishment that the democratic electorate gave to Berisha is 1 million times greater than the punishment that SPAK gave to warm himself in the family fireplace. It doesn't matter who Bardhi is anymore, I feel sorry that he is loyal to Berisha. Ilir Meta does not want to be in a coalition with Berisha. It seems clear that there is a reflection of Meta in relation to "Foltore" and Berisha. Meta is not refuting it, a press statement is issued and defends it, just to wash the mouth, but they are moving away from "Foltor" every day more and more. 

- Rama voted in Parliament for the arrest of Berisha and Basha did not. Have a comment?

It is the right action, it would not be up to Basha to vote for the removal of immunity. Having been in a government and on the same lists you can avoid the vote and he did that. While Edi Rama scolded him, he vented all the threats of Sali Berisha. The democratic electorate, unlike the socialists, is poorer, it has the lowest economic level of unemployment, and when the citizens saw that they were being accused of towers, they said, "We will come out to defend these people, who we have seen as a symbol of honesty, and a day will come when even he who has seen you as an idol becomes aware. Imagine if the media didn't give him so much space, what would happen?

- On Tuesday at 10 o'clock, a hearing will be held in the Special Court regarding the request of the Special Prosecutor's Office (SPAK) to change the security measure against Sali Berisha, from "mandatory appearance" to "house arrest". What will happen after the session? 

The decision with all the conditions, the time and the circumstances under which the arrest decision must be implemented, is given to the state police to execute it, applying the residence. If GJKKO accepts SPAK's request, the execution will take place on Tuesday. If Berisha is in the hall, he is taken by police car and escorted to his apartment. From there, the policeman stays at the door until the day the Court declares him guilty or innocent. The investigation must be completed, then the trial must be completed, which is a procedure that will go beyond the 2025 elections, after the 2025 parliamentary elections, because it is a complex process. It is imperative to respect the Court's decision. It may happen that an Appellate Court, a Constitutional Court, will invalidate the house arrest decision, as happened with Jamarbër Malltezi after he was released from prison. / TODAY
