According to the Special Court, former Minister of Health Ilir Beqaj and his former deputy Klodian Rjepaj inflated the costs of sterilization services by 56.4% with the aim of embezzling and stealing funds from the Ministry of Health.
In the decision of the judge of the preliminary hearing, every point of the contract concluded in 2015 between the Ministry and the concessionaire is analyzed, concluding that the contract was negotiated in favor of the winning company.
" The breaches of duty committed by Mr. Beqaj and Mr. Rjepaj are serious and with the sole purpose of granting the concession to Italian economic operators and the Albanian citizen, Mr. Ilir Rrapaj. The concession project was predetermined; the granting of the concession project itself, its duration, the value of the contract and all the actions taken by Mr. Beqaj and Mr. Rjepaj were to give legal form to these predetermined actions, but which in content have enabled the appropriation of state funds ," says the GJKKO.
The court adds that with the former minister's signature, the state has been forced to be a party to a contract from which it gains nothing.
" To finalize this goal of theirs, they have committed numerous violations in this procedure and have forced the Albanian state to be a party to a ten-year concession contract with considerable damage, without resolving the issue of sterilization for the entire country and the additional services provided, while this contract expires at the end of this year and the state will benefit from this contract, those for which it itself has paid from state funds. As for the benefits, Mr. Beqaj was aware of everything and was active all the time, with the aim of concluding the premeditated plan for providing sterilization services and other services, to predetermined operators, with a predetermined value, and this was also the reason why he committed many violations during the exercise of his duty ," says the GJKKO.
Together with the businessman who won the concession, Ilir Rrapaj, they are considered part of a criminal group.
" While, regarding the manner of cooperation in this case, I assess that we are not dealing with simple cooperation, this for Mr. Beqaj, Mr. Rjepaj and Mr. Rrapaj. Their cooperation is extended in time, predetermined and very well thought out, and every action taken has been with the aim of finalizing the concession contract, according to the interests of these entities. Each of these citizens has had a key role in this cooperation and the actions of each of them have been in the function of achieving a single goal, the creation of a procedure for the appropriation of state funds. The cooperation between these citizens has been special, within the framework of the structured criminal group ", says GJKKO, reports "Klan".
For the other former officials of the concession commission, the Court says that it has been proven that they were under the direction of the former deputy minister and did not participate in the concession procedures according to legal obligations, but simply signed.
