The Constitutional Court has decided today to review the appeal filed by Prime Minister Edi Rama against the decision of the Constitutional Court, which suspended Belinda Balluku from her duties as Deputy Prime Minister and Minister of Infrastructure and Energy.
The decision by the Constitutional Court was made with 5 votes in favor and 3 against, thus moving the case into a new procedural phase, where the full body of judges will analyze in depth the government's arguments and the legality of the measure used by the GJKKO.
With this decision, the Constitutional Court assesses that the government's request meets the formal conditions for consideration, but does not yet give a position on the merits of the case. The upcoming hearing will focus on the central question: does a criminal court have the right to suspend a member of the government cabinet, or does this action violate the constitutional balance and the functioning of the executive?
The government claims that the suspension measure interferes with its powers and paralyzes institutional decision-making, while critics of the appeal see this step as pressure on justice and an attempt to interfere with the open investigations against Balluk.
The final decision of the Constitutional Court is expected to have a direct impact on political developments and on the relationship between the executive and the justice system.
We recall that on November 20, the Special Court suspended the Deputy Prime Minister and Minister of Infrastructure and Energy from duty, also prohibiting her from leaving the country. She has been named a defendant in the procedures for the Llogara tunnel tender and is under investigation for the tender for Lot 4 of the Grand Ring Road. / Pamphlet
