The President of the Constitutional Court, Holta Zaçaj, has stated that the non-implementation of the decision on the mandate of the former Foreign Minister Olta Xhaçka (currently MP) is an unusual situation and impossible to happen in a democratic state.
The next day, April 8, the Council for Regulation, Mandates and Immunity will examine the file of deputy Olta Xhaçka for the finding of invalidity and the end of the mandate of the socialist deputy.
The decision of the Constitutional Court for the mandate of Olta Xhaçka, which has been kept in a "drawer" for more than a year by the SP in the Assembly, clashed last week with the majority and the opposition in the Conference of Speakers.
The head of the Parliamentary Group of the Democratic Party, Gazment Bardhi, requested during the meeting without the presence of the media at the Conference of Speakers that the decision of the Constitutional Court be implemented and the matter be passed to the Assembly, adding that the majority made absurd excuses from January 2023 until today.
Bardhi accuses the majority of eliminating MP Xhaçka and her family members from the investigations and said that this is a signal for SPAK not to investigate the MP and her family members.
He emphasized that the SP seeks to delay the issue, returning it once again to the Council of Mandates, when "the decisions of this Council have been subject to review by the Constitutional Court", said Bardhi.
While Speaker Lindita Nikolla declared during the meeting that the Council of Mandates will meet on Monday (April 8) and the procedure will continue.
Against MP Xhaçka, there is a decision of the Constitutional Court dated January 18, 2023.
14 months ago, the Constitutional Court decided to suspend the case after 1/5 of the members of the Assembly, part of the opposition, requested the annulment of the decisions of the Assembly, which did not approve the report of the DP that claims that the deputy Xhaçka was incompatible with the exercise of the mandate of her because of the status that her family had obtained.
On January 18 of a year ago, the Constitutional Court suspended the trial of the case, since according to the Constitution, the Assembly of the Republic of Albania will have to express its opinion first.
The President of the Constitutional Court herself, in her public appearance before the media for the first time for 2024, when she was asked about the mandate of Olta Xhaçka, stated that the non-implementation of the decision on the mandate of the former Minister of Foreign Affairs, currently a member of parliament, is an unusual and impossible to happen in a democratic state.
The Council for Regulation, Mandates and Immunity consists of 10 deputies, in equal representation between the majority and the parliamentary minority, which verifies the mandate of the deputy.
Facing each other in this council will be Bledi Çuçi, Gazment Bardhi, Enkelejd Alibeaj, Ervin Salianji, Klotilda Bushka, Arben Pëllumbi and Ermonela Felaj.
